93. Application for licence to sell 1 [champagne, etc.,] on prescription औषधीपत्रावर शॅम्पेन इ. विक्रीकरिता अनुज्ञप्ती अर्ज

Subject to provision of rule 92, any holder of a vendor's licence in Form F.L. II desiring to sell 2[Champagne, Port-type wine, Port-wine, Wincamis, Vibrona, Manola and Buckfast Tonic wine]2 on prescription may apply to the Collector for a licence in that behalf. The application shall contain the following particulars, namely:—
- Name and address of the applicant;
- Number of the Vendor's licence held by the applicant;
- Location of the premises in respect of which the applicant holds the vendor's licence.

On receipt of the application, the Collector may make enquires for verification of the details stated in the application and also such other enquires as he deems necessary. If he is satisfied that there is no objection to grant the licence, he may grant the applicant a licence in Form F.L. XIII on payment of a fee of 5[Rs. 25]5

2The licensee shall not sell 2[Champagne, Port-type wine, Port-wine, Wincamis, Vibrona, Manola or Buckfast Tonic wine]2 except on the production of a prescription and in a quantity exceeding the total quantity specified in the prescription :2
Provided that he may sell —
- 3[375 millilitres]3 of 2[Champagne, Port-type wine, Port-wine, Wincamis, Vibrona, Manola or Buckfast Tonic wine,]2 as the case may be, where the total quantity so specified is less than 3[375 millilitres]3; and
- 3[750 millilitres]3 thereof where such total quantity is more than 3[375 millilitres]3.

The provision of rules 84, 85, 86, 87, 88, 90, and 91 shall, as far as may be, apply in respect of a licence granted in Form F.L. XIII.
94. Possession etc., of 1[brandy, rum, etc.]. ब्रँडी, रम इ. जवळ बाळगणे

Any person may, without a licence, permit or pass, may possess, transport and consume or use.—
- any medicine containing such quantity of brandy or rum as has been dispensed to him under a prescription, or.
- any 1[Champagne, Port-type wine, Port-wine, Wincamis, Vibrona, Manola or Buckfast Tonic wine]1 sold to him on prescription, in accordance with the provisions of this part.

The purchase possession and transport of medicine, containing brandy or rum or of 1[Champagne, Port-type wine, Port-wine, Wincamis, Vibrona, Manola or Buckfast Tonic wine]1 by a person on behalf of an infirm or invalid person or any other person who is not physically fit shall be permitted without a licence, permit or pass provided that.
- the infirm or invalid or physically unfit person is a person in whose name a prescription prescribing medicine containing such brandy or rum, or prescribing 1[Champagne, Port-type wine, Port-wine, Wincamis, Vibrona, Manola or Buckfast Tonic wine]1 has been issued; and
- the name and address of the person purchasing, possessing or transporting 4[are endorsed by the licensee on the original prescription as well as on the cash memo in Form A referred to in sub-rule (6) of rule 87]4.
