SPIRITUOUS PREPARATIONS
THE BOMBAY SPIRITUOUS PREPARATIONS (MANUFACTURING) RULES, 1955

In exercise of the powers conferred by Section 143 of the Bombay Prohibition Act, 1949 (Bom. XXV of 1949), the Government of Bombay is pleased to make the following Rules, namely:

2. Extent and Commencement विस्तार आणि प्रारंभ
- These rules shall extend to the whole of the State of Bombay.
- They shall come into force on 26th July 1955.
- "Act" means the 1Bombay Prohibition Act, 19491;
- "Excise Supervision" means the supervision by the members of the staff of the Prohibition and Excise Department appointed in that behalf by the Commissioner;
- "Form" means a form appended to these rules;
- "licence" means a licence granted under these Rules;
- "licensee" means a person who has been granted a licence under these Rules;
- "licensed premises" means premises in respect of which a licence has been granted and includes a warehouse of the licensee approved by the Collector;
- "Spirituous preparation" means:
- any medicinal or toilet preparation containing alcohol, or
- any antiseptic preparation or solution containing alcohol, or
- any flavouring extract, essence or syrup containing alcohol which is determined to be fit for use as intoxicating liquor by the State Government under section 6-A of the Act;
- "to manufacture spirituous preparations in bond", with its grammatical variations, means to manufacture spirituous preparations without prepayment of excise duty leviable thereon but a bond for the payment of which on their removal after manufacture has been executed.
- Any person desiring to manufacture spirituous preparations shall apply to the Collector for a licence in that behalf.

**(a) "अधिनियम" (Act)**

**(b) "उत्पादन शुल्क पर्यवेक्षण" (Excise Supervision)**
Collector किंवा Commissioner आपल्या विभागातून कर्मचारी नियुक्त करतो, जो दारू बनवणाऱ्यांच्या कामावर नजर ठेवतो.
उदा., दारूची दुकान नियमित तपासणी घेणे.
**(c) "नमुना" (Form)**
अर्ज, परवाना इत्यादीसाठी सरकारने ठरलेला खास नमुना असतो.
**(d) "licence"**
या नियमानुसार दिलेली परवाना/अनुमती.
**(e) "licensee"**
ज्या व्यक्तीला licence मिलला आहे, त्याला licensee म्हणतात.

**(g) "मद्यसारयुक्त तयारी" (Spirituous Preparation)**
दारू असलेली ही ३ प्रकारची तयारी असू शकते:
• औषधी किंवा साबणची तयारी (जसे cough syrup)
• जंतुनाशक द्रावण (जसे antiseptic lotion)
• स्वाद/सार असलेली चीज (जसे vanilla extract)
परंतु राज्य शासन ठरवून देते की कोणती "मादक" मानायची आणि कोणती नाही.
**(h) "बंधपत्रात तयारी बनवणे" (Manufacture in Bond)**
तयारीदार दारूवरील शुल्क **तुरंतच न भरता** बाद्यतेच्या कागदपत्रावर वचन देऊन काम करतो.
