PRELIMINARY

1. Short title and extent शीर्षक आणि व्याप्ती

  1. 1(1) These rules may be called the Maharashtra Toddy Shops (Licensing) and Toddy Trees (Tapping) Rules, 1968.1
  2. 1(2) These rules extend to the whole of the State of Maharashtra except the Tribal areas.1

2. Definitions व्याख्या

In these Rules, unless there is anything repugnant in the subject or context—

  1. "Act" means the @Bombay Prohibition Act, 1949@ Bombay;
  2. 2(a) "Auction-cum-Tender Order" means the Maharashtra Toddy Shops (Grant of Licenses) by Auction-cum-Tender Order, 20012
  3. 2(a2) "bid" means an offer of bid money by bidder in an auction and includes a tender;2
  4. "duty" means duty levied under section 109 of the Act;
  5. "Form" means a form appended to these Rules;
  6. "licence" means a licence granted under these Rules;
  7. "licensed shop" means the shop in which a licensee has been licensed to sell toddy under his licence;
  8. "licensee" means the holder of a licence;
  9. "superintendent" means the Superintendent of Prohibition and Excise or the District Inspector of Prohibition and Excise, as the case may be;
  10. 4"Toddy" means fermented juice drawn from a coconut, brab, date or any kind of palm tree4 containing not more than five per cent alcohol by volume but does not include sweet toddy, nira or neera;
  11. 5("Tribal area" means the area specified in the Schedule to these rules.5

PART II

REGULATION OF SALE OF TODDY

विषयात किंवा संदर्भात एतद्विरुद्ध काही नसल्यास या नियमांमध्ये,— (अ) "अधिनियम" म्हणजे मुंबई दारूबंदी अधिनियम, १९४९; (अ१) "लिलाव-तद्वत-निविदा आदेश" म्हणजे महाराष्ट्र ताडी दुकाने (लिलाव-तद्वत-निविदाद्वारे परवान्यांचे अनुदान) आदेश, २००१; (अ२) "बोली" म्हणजे लिलावात बोलीदाराने बोली रकमेची ऑफर आणि त्यात निविदा समाविष्ट आहे; (ब) "शुल्क" म्हणजे अधिनियमाच्या कलम १०९ अन्वये आकारण्यात येणारे शुल्क; (क) "नमुना" म्हणजे या नियमांना जोडलेला नमुना; (ड) "परवाना" म्हणजे या नियमांखाली मंजूर केलेला परवाना; (इ) "परवानाप्राप्त दुकान" म्हणजे ज्या दुकानात परवानाधारकास त्याच्या परवान्याखाली ताडी विक्री करण्यास परवाना देण्यात आला आहे ते दुकान; (फ) "परवानाधारक" म्हणजे परवान्याचा धारक; (ह) "अधीक्षक" म्हणजे दारूबंदी आणि उत्पादन शुल्क अधीक्षक किंवा दारूबंदी आणि उत्पादन शुल्क जिल्हा निरीक्षक, यथास्थिति; (आय) "ताडी" म्हणजे नारळ, ब्राब, खजूर किंवा कोणत्याही प्रकारच्या ताड झाडातून काढलेला आंबवलेला रस ज्यात आकारमानानुसार पाच टक्क्यांपेक्षा अधिक मद्यार्क नाही परंतु त्यात गोड ताडी, नीरा किंवा नीर समाविष्ट नाही; (ज) "आदिवासी क्षेत्र" म्हणजे या नियमांना जोडलेल्या अनुसूचीत विनिर्दिष्ट केलेले क्षेत्र.

**विस्तृत व्याख्या:**

**(अ) "अधिनियम" = मुंबई दारूबंदी अधिनियम, १९४९**
- या Rules मध्ये जेव्हा "अधिनियम" असे म्हटले जाते, तर त्याचा अर्थ १९४९ चा दारूबंदी कायदा आहे.

**(अ१) "लिलाव-तद्वत-निविदा आदेश"**
- ताडी दुकानांचे परवाने देणे लिलाव (auction) किंवा निविदा (tender) द्वारे कसे करायचे हे सांगणारा आदेश (२००१).

**(अ२) "बोली"**
- लिलावात जेव्हा तुम्ही किंमत देऊ करता (बोली लावता), तर ती "बोली" आहे.
- उदा., जर परवानासाठी ₹50,000 ऑफर दिले, तर ते बोली आहे.

**(ब) "शुल्क"**
- Toddy shop चलवण्यासाठी तुम्हाला सरकारला हर वर्षी जे पैसे देणे पडते, ते शुल्क आहे.

**(क) "नमुना"**
- अर्ज भरताना, परवाना मिळवताना कोणत्या Form वापरायचे हे नियमांच्या शेवटी दिलेले आहे.

**(ड) "परवाना"**
- ताडी दुकान चलवण्यासाठी सरकारकडून मिळणार्‍या परवानास परवाना म्हणतात.

**(इ) "परवानाप्राप्त दुकान"**
- ज्या दुकानात परवाना असलेला माणूस (licensee) कानूनी पद्धतीने ताडी विक्री करतो, ती दुकान.

**(फ) "परवानाधारक"**
- जो माणूस परवाना धारण करतो, म्हणजे ताडी दुकान चलवण्याचा परवाना असलेला व्यक्ती.

**(ह) "अधीक्षक"**
- दारू आणि उत्पादन शुल्क विभागात काम करणारा senior अधिकारी जो निरीक्षण करतो.

**(आय) "ताडी"**
- नारळ, ताड किंवा खजूरच्या झाडातून निघणारा आंबवलेला रस, ज्यात ५% पेक्षा कमी दारू आहे.
- मीठ नीरा (sweet toddy) या परिभाषेत आत नाही.

**(ज) "आदिवासी क्षेत्र"**
- महाराष्ट्रातील विशेष आदिवासी भाग, जिथे हे नियम लागू होतात.

3. Prohibition of sale of toddy except under a licence विनापरवाना ताडी विक्रीस मनाई

No person shall sell toddy except under a licence.

कोणतीही व्यक्ती परवान्यावाचून ताडी विकणार नाही.

**Rule 3 म्हणणारं आहे:**

• ताडी विकायची असेल तर तुम्हाला सरकारकडून **licence (परवाना)** घेणं गरजेचं आहे.

• जर तुमच्याकडे licence नाहीये तर ताडी विकणं **पूर्णपणे गैरकायदेशीर** आहे.

• याचा अर्थ असा की, छोट्या दुकानात असो वा मोठ्या गोदामात, **सर्वच ठिकाणी licence आवश्यक** आहे.

**व्यावहारिक उदाहरण:**

उदा., जर तुम्हाला ताडीचा दुकान सुरु करायचा असेल तर:
- प्रथम Collector किंवा district authorities कडे **licence साठी अर्ज** करावा लागेल
- licence मिळाल्यानंतरच तुम्ही ताडी विकू शकता
- licence नसल्यास हे केल्यास तुम्हाला **जेल किंवा दंड** होऊ शकतो

**कायदेशीर परिणाम:**

जर कोणी viना licence के ताडी विकतो आणि पकडला जातो तर:
- तुम्हाला **दंड भरावा लागू शकतो**
- तुमचा स्टॉक **जप्त** होऊ शकतो
- गंभीर प्रकरणात **कारावास** देखील होऊ शकतो

म्हणून हा नियम सोप्या भाषेत म्हणजे: **"ताडीचा व्यवसाय सरकारच्या परवानीशिवाय करणं गैरकायदेशीर आहे."**

4. Grant of licence परवाना देणे

  1. 6Every person6 6whose bid or tender has been accepted under the6 8Auction-cum-tender8 order may, subject to the provisions of sub-rule (2) be granted a licence in Form TD-1 on his executing a counterpart agreement in Form TD-2 within 6fifteen days6 of auction 2or of the acceptance of the tender2
  2. 7(2) No licence shall be granted in respect of any shop.—7
    1. (a) which is less than nine square metres in area and which, in the opinion of the Collector, will not be adequate for consumption of toddy and where such consumption will be in public view;
    2. (b) which, if situated in the areas within the jurisdiction of any Municipal Corporation or 'A' Class or 'B' Class Municipal Council, is within a distance of fifty metres and if situated elsewhere, one hundred metres, from any educational or religious institution 9or any Statue of National Personality9 or
    3. (c) which is situated within a distance of one hundred metres from any bus stand, station or depot of the Maharashtra State Road Transport Corporation; or
