25. Licence for medical purpopses or registered medical practitioners वैद्यकीय उद्देश किंवा नोंदणीकृत वैद्यकीय व्यावसायिकांसाठी परवाना

25. (1)

Any registered medical practitioner desiring to use ordinary denatured spirit for medical purposes may apply to the 1Inspector of State Excise of the area1 as the case may be, for a licence in that behalf. The application shall contain the following particulars, namely:

  1. (i) The name and address of the applicant;
  2. (ii) Place where the ordinary denatured spirit will be kept and used;
  3. (iii) Quantity or ordinary denatured spirit to be used per month ;
  4. 2(iv) Registration number or serial number of the applicant on the register or list maintained under any law for the time being in force in any part of the State relating to medical practitioners, dentists or veterinary practitioners under which the applicant is entitled to practise ;2
  5. (v) Since when the applicant is running the dispensary ;
  6. (vi) What licenses the applicant is holding;]
  7. 3(vii) Whether the applicant has applied for the said licence in the past and whether it was rejected, and if so, why was it rejected.3

(2)

On receipt of the application under sub-rule (1), 4Inspector of State Excise of the area for a license in Form DS-III4 shall make such inquiries as he may deem necessary and if he is satisfied that there is no objection to grant the licence applied for, he may grant the applicant a licence in Form D.S. III on payment of a fee of 5fifty rupees per year, or five hundred rupees for ten years, respectively5 and shall also issue a certificate in the form specified in the permit as evidence of the grant of permit.

6Provided that, the Inspector of State Excise of the area for a licence in Form DS-III may grant a licence in Form DS-III for use of specially denatured spirit after obtaining prior permission of the Commissioner6

No licence under sub-rule (2) shall be granted for a quantity exceeding 7fifteen7 bottles per month] in so far as it relates to the use of ordinary denatured spirit

(4)

The licensee shall use the ordinary denatured spirit purchased by him under the licence solely for medical use and he shall not use it for any other purpose.

(5)

The licensee shall not allow ordinary denatured spirit possessed by him under the licence to be used except in his own presence or in the presence of a person authorised by him in writing in that behalf

(6)

The privileges of purchase, transport and possession of ordinary denatured spirit granted under the licence shall extend only so far as they are incidental to its use in accordance with these rules and the conditions of the licence.
