Licence to Registered Medicinal Practitioners and persons in Charge of Hospitals and Dispensaries for dispensing Spirituous Medicinal Preparations

12. Application for licence for dispensing spirituous medicinal preparations मद्यसारयुक्त औषधीय सिद्धपदार्थ वितरणाकरिताच्या परवण्याकरिता अर्ज

Any registered medicinal practitioner or any person in charge of a hospital or dispensary desiring to dispense spirituous medicinal preparations shall apply to the Collector for a licence for dispensing such medicinal preparations. The application shall contain the following particulars:

(i) Name and address of the applicant;
(ii) Whether the applicant is a registered medicinal practitioner, his registration number and the name of the authority by which he has been registered;
(iii) Where the applicant is a person in charge of a hospital or dispensary his designation and the name of the hospital or dispensary of which he is in charge.

मद्यसारयुक्त औषधीय सिद्धपदार्थांचे वितरण करू इच्छिणारा कोणताही नोंदणीकृत वैद्यकीय व्यवसायिक किंवा रुग्णालय किंवा दवाखान्याचा प्रभारी कोणतीही व्यक्ती अशा औषधीय सिद्धपदार्थांच्या वितरणासाठी परवान्यासाठी जिल्हाधिकाऱ्यांकडे अर्ज करील. अर्जात पुढील तपशील असतील:

(i) अर्जदाराचे नाव आणि पत्ता

(ii) अर्जदार नोंदणीकृत वैद्यकीय व्यवसायिक असल्यास, त्याचा नोंदणी क्रमांक आणि ज्या प्राधिकरणाने त्याची नोंदणी केली त्याचे नाव

(iii) अर्जदार रुग्णालय किंवा दवाखान्याचा प्रभारी व्यक्ती असल्यास, त्याचे पदनाम आणि तो प्रभारी असलेल्या रुग्णालयाचे किंवा दवाखान्याचे नाव

Rule 12 काय सांगते:

**कोण अर्ज करू शकतो?**

**कोणाला अर्ज करावा लागतो?**
तुम्हाला Collector (जिल्हाधिकारी) कडे licence घेण्यासाठी अर्ज करावा लागतो.

**अर्जात कोणती माहिती द्यायची?**

१) **तुमचे नाव आणि पत्ता** — कुठे राहता आहात ते सांगा

२) **जर तुम्ही डॉक्टर असाल तर:**
• तुमचा नोंदणी क्रमांक (registration number)
• कोणत्या संस्थेने तुम्हाला नोंदणी दिली ते सांगा
• उदा., "मुझे मेडिकल काउंसिल ऑफ इंडिया ने रजिस्टर किया है, मेरा नंबर 12345 है"

३) **जर तुम्ही रुग्णालय/दवाखान्याचे प्रभारी असाल तर:**
• तुमचे पद/पदनाम (जसे Medical Director, Manager, Chief Doctor)
• तुम्ही कोणत्या रुग्णालय/दवाखान्याचे प्रभारी आहात ते सांगा
• उदा., "मैं सिटी हॉस्पिटल का मेडिकल डायरेक्टर हूँ"

**सोप्या शब्दात:** Collector चाहतो की वह जाणून घेतील तुम्ही कोण आहात, तुम्ही योग्य डॉक्टर आहात की नाही, आणि कुठे काम करता आहात — मग तरच तुम्हाला दारूसारखी औषधे वितरित करण्याची परवानगी देईल.

13. Grant of licence परवाना देणे

On receipt of an application under rule 12, the Collector may make inquiries for verification of the details stated in the application and also such other inquiries as he deems necessary. If he is satisfied that there is no objection to grant the licence applied for he may grant the applicant a licence in Form "S. M. P. II." On payment of ¹[a fee of rupee ten¹ per annum]:

²[provided that for the purpose of charging the fee, the fraction of a year shall be reckoned as one complete year.]²

नियम १२ अन्वये अर्ज प्राप्त झाल्यावर, जिल्हाधिकारी अर्जात नमूद केलेल्या तपशीलांच्या पडताळणीसाठी चौकशा करू शकतात तसेच त्यांना आवश्यक वाटतील अशा इतर चौकशा करू शकतात. अर्ज केलेला परवाना मंजूर करण्यास कोणतीही हरकत नसल्याचे त्यांना समाधानकारक वाटल्यास, ते १[प्रतिवर्ष २[रुपये दहा] शुल्क] भरल्यावर अर्जदारास नमुना "S.M.P. II" मध्ये परवाना मंजूर करू शकतात:

**Collector ला काय करावे लागतो:**
• जर तुम्ही Rule 12 नुसार licence साठी अर्ज दिला तर Collector तुमच्या अर्जातील सर्व तपशील तपासतो.

• तुम्हाला प्रतिवर्षी ₹10 (दहा रुपये) भरावे लागतो.
• उदा., जर तुमचा licence जानेवारीत मंजूर झाला आणि डिसेंबरला संपतो, तरीही तुम्हाला पूर्ण वर्षाचा ₹10 भरावा लागेल — अधिक दिन-महिने मोजले जात नाहीत.

**साधारण शब्दांत:** तुमच्या licence अर्जाची तपासणी होते, मंजुरी मिळते, आणि दरवर्षी दहा रुपये भरले की तुमचा licence वैध राहतो.

14. Duration of licence परवान्याचा कालावधी

³[The licence under rule 13 may be granted or renewed for a period not exceeding three years at a time, so however as not to extend beyond the 31st day of March according to the duration for which the licence is granted;

Provided that in the case of a registered medical practitioner, such licence may be granted or renewed for a period not exceeding three years at a time but not beyond 31st March of the third year from the date of the commencement of the licence.]³

नियम १३ अन्वये परवाना एका वेळी तीन वर्षांपेक्षा जास्त नसलेल्या कालावधीसाठी मंजूर किंवा नूतनीकृत केला जाऊ शकतो, परंतु परवाना ज्या कालावधीसाठी मंजूर केला जातो त्यानुसार ३१ मार्चपलीकडे वाढणार नाही;

परंतु नोंदणीकृत वैद्यकीय व्यवसायिकाच्या बाबतीत, असा परवाना एका वेळी तीन वर्षांपेक्षा जास्त नसलेल्या कालावधीसाठी परंतु परवान्याच्या प्रारंभ तारखेपासून तिसऱ्या वर्षाच्या ३१ मार्चपलीकडे मंजूर किंवा नूतनीकृत केला जाऊ शकतो.]

**रजिस्टर्ड डॉक्टरांसाठी (अपवाद):**

• डॉक्टरांना licence 3 वर्षांसाठी दिला जाऊ शकतो।

• पण तो licence तिसऱ्या वर्षाच्या 31 मार्चला संपणार हवे।

उदा., जर डॉक्टरला 15 मे 2024 ला licence दिला गेला, तर तो 31 मार्च 2027 ला संपेल (पूर्ण 3 वर्ष मिळेल)।

**मुद्दा:** सर्वांना licence नूतनीकृत (renew) करवावे लागते — ते आपोआप वाढत नाही!

15. Inspection of licensed premises, etc. परवानाप्राप्त जागेची तपासणी वगैरे.

(1) The licensed premises and all medicinal preparations there in contained shall at all times be open to inspection by any officer empowered under section 122 of the Act.
(2) The licensee shall, when so required by any Prohibition Officer not below the rank of a Sub-Inspector of Prohibition and Excise, give an explanation in writing regarding any irregularities detected at his licensed premises and shall furnish any information regarding management of the said premises. He shall answer all questions put to him to the best of his knowledge and belief. He shall also, if so required, allow any officer empowered under section 122 of the Act to take samples of medicinal preparations free of cost for analysis.

15.A. Transport of spirituous medicinal preparation.

(1) No licensee shall transport any spirituous medicinal preparation exceeding ⁴[five litres]⁴ in quantity except under a valid transport pass.
