3. Definitions व्याख्या

  1. 1Act1 means the @Bombay Prohibition Act, 1949@;
  2. (3) 2Club licensee2 means a person holding a club licence under these rules;
  3. 3(3A) "Country liquor"3 has the same meaning as assigned to it in clause (c) of rule 2 of the Maharashtra Country Liquor Rules, 1973;
  4. (4) "Duty-paid foreign liquor" means foreign liquor on which
    1. duty leviable under Indian Tariff Act, 1934, or 4the Sea Customs Act, 19624, or
    2. the excise or countervailing duty under the Act has been paid and includes foreign liquor which is exempted from such duty;
  5. (5) "Excise supervision" means the supervision by the members of the staff of the Prohibition and Excise Department appointed in that behalf by a competent authority;
  6. (6) 5"Foreign Liquor" means potable duty-paid foreign liquor of the following kinds, namely:—5
    1. 6(a) "Spirits" means brandy, whisky, [rum], [club cup], gin, liquors and milk punch,6
    2. 7(b) "Wines" means Champagne, Moselle, Burgundy, Chianti, White Wines, Clarets, Hocks, Riesling, Madeira, Ginger Wine; Port-type, Port, Vermouth, Sherry; [Wincamis, Victoria, Manola, Buckfast Tonic-Wine] and such other wines as the State Government may by notification in the Official Gazette specify [being wines having alcoholic strength exceeding 5 per cent, alcohol by volume (i.e. equivalent to 8.75 per cent, of proof spirit)];]7
    3. 8Explanation.—For the purposes of this item "Wincamis" means Wincamis prepared according to the following formula, namely:— Alcohol (by volume) 18 per cent. Sodium Glycerophosphate liquid B.P.C. 0.7 per cent. w/v. Meat Extract 0.46 per cent. w/v. Malt 0.46 per cent. w/v.8

    4. 9(c) "Fermented liquor" means ale, beer, milk stout (Porter), Cider [having alcoholic strength exceeding 5 per cent, alcohol by volume (i.e. equivalent to 8.75 per cent, of proof spirit)] and such other fermented liquors as the State Government may by notification in the Official Gazette specify;9
    5. 10(d) "Mild liquor" means— (A) Mild beer having alcoholic strength not exceeding 5 per cent. v/v which is equivalent to 8.75 per cent. of proof spirit; or (B) Any foreign liquor other than mild beer having alcoholic strength not exceeding 5 per cent. v/v which is equivalent to 8.75 per cent. of proof spirit;]10

## मुख्य व्याख्या (Key Definitions):

**कायदा (Act)** = मुंबई दारूबंदी कायदा १९४९ हे मूळ कायदा आहे।

**Club अनुज्ञप्तीधारक** = ज्याला या नियमांतर्गत club licence मिलेला आहे अशी व्यक्ती।

**देशी दारू** = महाराष्ट्र देशी दारू नियम, १९७३ मध्ये दिलेली व्याख्या आहे तीच वापरली जाते।

**विदेशी दारू** = पिण्यायोग्य, शुल्क भरलेली विदेशी दारू, जी खालील प्रकारची असू शकते:
- (i) **Spirits** = Brandy, Whisky, Rum, Gin वगैरे
- (ii) **Wines** = Champagne, Port, Sherry, Burgundy इत्यादी (कमीत कमी 5% अल्कोहल असणे आवश्यक)
- (iii) **Fermented liquor** = Beer, Ale, Cider वगैरे (5% पेक्षा जास्त अल्कोहल)
- (iv) **Mild liquor** = 5% पेक्षा कमी अल्कोहल असलेली दारू
- (v) **Local liquor** = काजू, महुआ किंवा इतर फळांपासून स्थानिकपणे तयार केलेली दारू

**उत्पादन शुल्क पर्यवेक्षण** = दारूबंदी आणि उत्पादन शुल्क विभागाचे कर्मचारी दारूचे तपासणी आणि नियंत्रण करतात।

**Licensed premises** = ज्या जागेला licence मिलेली आहे ती जागा (दुकान, होटेल इत्यादी)।

**Permit-holder** = ज्याकडे permit (परवाना) आहे अशी व्यक्ती, किंवा विदेशी पर्यटकासाठी जारी केलेला liquor permit असलेली व्यक्ती।

**Wholesale विक्री** = licensed retailers किंवा wholesalers ना दारू विकणे।

**Unit (मद)** = दारूचे मापन:
- 750 मि.ली. spirit किंवा देशी दारू = 1 unit
- 1000 मि.ली. spirit = 1 unit
- 1500 मि.ली. wine = 1 unit
- 2600 मि.ली. beer/fermented liquor = 1 unit

**Growler** = 1-5 लिटर धारण करणारे भांडे, जिथे microbrewery किंवा restaurant-brewery परवानाधारक kegs वरून beer भरून देतात।

**Prescription** = नोंदणीकृत डॉक्टरने दिलेले औषधपत्र (वैद्यकीय उद्देशांसाठी दारू मिळवण्यासाठी)।

**Privilege personage** = कायद्याच्या कलम ४१ अंतर्गत विशेष अधिकार असलेली व्यक्ती।
