5. Grant of licence
The permit-holder shall not be in charge of any vehicle or animal if he is drunk and incapable of taking care of the vehicle or animal.

**अर्जाची प्रक्रिया:**
- तुम्ही दारू विक्रीसाठी licence अर्ज Collector किंवा State Excise Superintendent यांना देता.
- त्यांनी अर्जातील सर्व माहिती (पत्ता, दोकान किंवा warehouse चे स्थान, तुमचा व्यवसाय यानेही तपासणी करतात.
**Committee द्वारे मंजूरी:**
- Collector हा अर्ज एक Committee (rule 44-A अंतर्गत) समोर मांडतात.
- ही Committee तुमच्या योग्यतेचा विचार करून शिफारस करतात.
**अंतिम मंजूरी:**
- Committee ची शिफारस विचारून, Collector हे तपासतात की:
• तुमचे दोकान/warehouse नियमांच्या अनुरूप आहे का?
• कोणतेही कायदेशीर आपत्ती तर नाही?
- जर सर्व काही ठीक असेल तर licence दिले जाते.
**खर्च:**
- तुम्हाला **licence fee** (State Government किंवा Commissioner ठरवतो) भरावा लागतो.
- तसेच **₹1,00,000 (एक लाख रुपये) का guarantee deposit** देणे बंधनकारक आहे.
**नोट:** काही परिस्थितीत State Excise Superintendent सरळ licence मंजूर करू शकतात, Committee शिवाय.
6. Duration of licence
The permit may be cancelled or suspended in accordance with the provisions of section 54 of the said Act.
नियम ५ अंतर्गत कोणतीही अनुज्ञप्ती अनुज्ञप्ती सुरू झाल्याच्या तारखेनंतर येणाऱ्या ३१ मार्चपेक्षा जास्त कालावधीसाठी मंजूर करण्यात येणार नाही.

• **Licence कितका काळ चलतो?** — जर तुम्हाला Foreign Liquor (विदेशी दारू) विक्रीसाठी licence मिलतो, तर तो जास्तीत जास्त १ साल चालू शकतो.
• **अंतिम तारीख:** तुमचा licence कधीही सुरू व्हा न व्हा, तो ३१ मार्चला समाप्त होतो. उदा., जर तुमचा licence १ जानेवारीला सुरू होतो, तर तो पुढील साल ३१ मार्चला संपतो. किंवा जर २ ऑक्टोबरला सुरू होतो, तर तर पुढील साल ३१ मार्चला संपतो.
• **क्यामुळे?** — महाराष्ट्र शासन हर साल ३१ मार्चला सर्व licence रीन्यू करायचे ठरविले आहे. यामुळे प्रशासनासाठी नियंत्रण सोपे होतो.
• **पुन्हा licence घ्यायचे असेल?** — licence संपल्यानंतर तुमुला नवीन अर्ज भरायचा लागतो आणि नवीन fee भरायचे लागतात. तुम्ही आणखी एक साल licence मिळवू शकता.
• **महत्वाचे:** licence संपण्याच्या आधीच नवीन अर्ज दाखल करणे चांगले — नाहीतर तुमचा व्यवसाय बंद झाईल.
7. Only foreign liquor authorised by Commisssioner to be imported and removed from customs frontier, etc.
In case this permits cancelled or suspended during the currency of the permit period oris not renewed on its expiry, the permit-holder shall surrender the whole of the unconsumed stock of foreign liquor forthwith to the Collector. The stock of liquor so surrendered shall be sold by the Collector and the proceeds of the sale shall, after deducting the expenses and any sum due to the State Government, be returned to the permit-holder.

विस्तृत माहिती:
**मुख्य नियम:**
• जर तुमच्याकडे trade किंवा import licence असेल आणि विदेशी दारू आयात करायचं असेल, तर तुम्हाला Commissioner कडून अधिकृति (authorisation) घ्यावी लागते।
• Customs frontier वरून दारू काढून नेण्यापूर्वी Commissioner च्या परवानगी घ्यावी लागते।

• Commissioner तुमचे licence ला Form F.L. I मध्ये endorsement देईल — यासाठी तुम्हाला ₹2,50,000 प्रति वर्ष भरावे लागतील।
**Label approval fee (दारूच्या बाटल्यावरील लेबल्सचा खर्च):**
**Spirits (मजबूत दारू) साठी:**
- पहिल्या 10 labels — प्रत्येकी ₹10,000 प्रति वर्ष
- 10 पेक्षा जास्त labels — प्रत्येकी ₹5,000 प्रति वर्ष
**Wine आणि Beer साठी:**
- पहिल्या 10 labels — प्रत्येकी ₹5,000 प्रति वर्ष
- 10 पेक्षा जास्त labels — प्रत्येकी ₹2,500 प्रति वर्ष
**महत्वाचे बातमी:**
• तुमच्याकडे सिर्फ अधिकृत विदेशी दारूच हवं — दुसरी कोणी दारू import किंवा विक्रय करू शकत नाहीत।
• सर्व शर्तीचे पालन करावे — नाहीतर licence suspend किंवा रद्द होऊ शकते।
