48D. Grant of license and its duration.—
(1) On receipt of an application under rule 48C, the Superintendent, State Excise shall grant the license in Form EL. IV-A within one working day.
(2) All provisions of rules 49 to 52, 56 and 58 of the rules for hotel and club licenses shall apply mutatis mutandis to the license granted under rule 48D.1]1
2Provided that, for any premises not registered under the proviso to rule 48A, may apply for temporary licence in their behalf for every such Wine festival or festival.2

Rules for Hotel and Club Licences
कोणत्याही स्थानिक स्वराज्य संस्थेच्या अधिकारक्षेत्रातील भागात असलेल्या कोणत्याही तात्पुरत्या क्लबसंबंधी नियम ४८ए आणि ४८सी अंतर्गत कोणतीही अनुज्ञप्ती मंजूर केली जाणार नाही.
तात्पुरत्या क्लबला दारूचा licence देणे हे महामार्गांपासूनच्या अंतरावर अवलंबून असते. छोट्या गावांमध्ये २२० मीटर आणि इतर जागी ५०० मीटर अंतर असणे आवश्यक आहे. License मिळालेवर होटेल-क्लबचे इतर नियम लागू होतात.

**Rule 48D म्हणजे काय:**
• तात्पुरत्या क्लबला (wine festival किंवा अन्य उत्सवांसाठी) दारूचा licence देण्यासाठी महामार्गांपासून किमान अंतर असणे आवश्यक आहे।
• **अंतराचे नियम:**
- जर स्थानिक स्वराज्य संस्थेचे लोकसंख्या २०,००० किंवा कमी असेल तर — National किंवा State highway च्या edge पासून किमान २२० मीटर अंतर असावे
- इतर सर्व ठिकाणी — ५०० मीटर अंतर असावे
- Service road असेल तर त्याच्या edge पासून हेच अंतर मोजणे
• **अंतर कसे मोजायचे:**
क्लबच्या entrance च्या मध्यबिंदूपासून सरावट रस्त्याने (footpath/pedestrian way) महामार्गाच्या edge पर्यंत मोजायचे

**Sub-Rule (1) — License कधी मिळते:**
• तात्पुरत्या क्लबचा अर्ज State Excise Superintendent यांच्याकडे जाते
• अर्ज मिळाल्यानंतर **एक कामकाजी दिवसात** Form FL-IV-A मध्ये licence मंजूर होतो
• याचा अर्थ — जलद process आहे

**Sub-Rule (2) — बाकी नियम लागू होणे:**
• जेव्हा temporary club licence मिळेल, तर होटेल आणि क्लबच्या Rule 49 ते 52, 56, 58 हे सर्व नियम त्याच्यावर लागू होतात
• मतलब — licence दिल्यानंतरचे conduct, renewal, penalty, आदि सर्व सामान्य नियम पाळायचे
49. Employment of servants
(1) Subject to the provisions of sub rule (2), the hotel or club licensee shall cany on the business of selling foreign liquor at a hotel or club either personally or by an agent or servant duly authorised by him in this behalf by a nokamama in Form E L. XIV signed by himself and countersigned by a Prohibition and Excise Officer not lower in rank than a Sub-Inspector :
Provided that, any such nokamama signed by the licensee shall be valid until countersignature is refused. For every nokamama issued by him and countersigned, the licensee shall pay a fee of Rupee 1.
(2) A hotel or club licensee shall not authorise any of the following persons as his agents or servants, namely :
- (i) Persons below twenty-one years od age ;
- (ii) Persons suffering from any infectious or contagious disease ;
- (iii) Persons of unsound mind ;
- (iv) Persons who, in the opinion of the Collector; are of a bad character ;
- (v) Persons whose nokarnamas or licences have previously been cancelled ; or
- (vi) Persons convicted of any offence ;
Provided that, in the case of persons falling under clauses (iv), (v) and (vi), the Collector may make such inquiries as he deems necessary for the removal of disqualification and if he is satisfied that there is no objection he may, for reasons to be recorded in writing remove the same at any time :
Provided further that, if for any reasons the Collector shall order the withdrawal of any nokamama issued by the licensee, the nokamama shall forthwith be withdrawn.
50. Source of supply
Foreign liquor required for a licensed hotel or club shall not be bought except from a person holding a trade and import licence and shall not be transported from the latter's premises to the hotel or club premises except under a transport pass.
अनुज्ञप्तीप्राप्त हॉटेल किंवा क्लबसाठी आवश्यक असलेली विदेशी दारू व्यापार आणि आयात अनुज्ञप्ती धारण करणाऱ्या व्यक्तीकडून वगळता खरेदी केली जाणार नाही आणि नंतरच्या जागेपासून हॉटेलपर्यंत वाहतूक केली जाणार नाही.

• **दारू कोठून खरेदी करावी?** — लायसन्सप्राप्त हॉटेल किंवा क्लबला विदेशी दारू फक्त एका विशेष व्यक्तीकडून खरेदी करता येते — ज्याकडे "trade and import licence" आहे.
• **वाहतूक कसी करावी?** — हॉटेल/क्लबमध्ये दारू नेताना तुम्हाला "transport pass" (परिवहन परवानगी) लागते. बिना या परवानगीच्या दारू नेऊ शकत नाही.

**खास बाबी (exceptions):**
• **वाइन साठी:** जर वाइन विक्रयासाठी लायसन्स आहे, तर तुम्ही सरळ winery (द्राक्षमदिरा तयार करणाऱ्या) कडून खरेदी करू शकता — जर त्या winery कडे "manufactory licence" (Form BRL) आणि valid transport pass (Form BR IX) आहे.
• **बीअर साठी:** Microbrewery किंवा restaurant-brewery कडून सरळ बीअर घेता येते — पण excise duty भरुन, आणि फक्त 5 लिटर किंवा त्यापेक्षा जास्त packed form मध्ये, valid transport pass (Form BR IX) सह.
• **खाली FL-II licence असलेल्या विक्रेत्यांकडून:** काही जिल्ह्यांमध्ये जर FL-1 (wholesale) licence धारकांकडे दारूच्या ब्रान्डची कमतरता असेल, तर Government ची अनुमति घेऊन FL-II licence असलेल्या विक्रेत्यांकडून हॉटेल/क्लब दारू घेऊ शकतात. पण त्याचा विक्रय-खरेदी रेकॉर्ड राखावा लागतो.

**साधारणपणे:** परवानगी असलेली दुकान, वाइन हाऊस किंवा ब्रूअरी — फक्त इथूनच खरेदी करा आणि transport pass न विसरता!
