2. CONDITIONS OF PROMOTION:
The promotion is granted subject to the following conditions:
Condition 1: Temporary Status & Seniority Bar
- The promotion is granted in temporary capacity only (तात्पुरत्या स्िरूपात).
- The promotion is subject to the decision rendered in Special Leave Petition No. 28306/2017 pending before the Maharashtra Supreme Court.
- The promoted officers shall NOT acquire any rights to regular promotion, seniority, or seniormost position as a result of this temporary promotion (सेिाज्येष्ट्ठतेनुसार, खुल्या प्रिगातील पदाांिर).
- No seniority benefits or permanent status are conferred by this temporary promotion.
Condition 2: Service Review at Age 50/55 Years
- The promotion is subject to service review decision to be conducted when the promoted officer completes 50/55 years of service (सांबांवधत अवधकाऱ्याांच्या ियाच्या 50/55 व्या िषांनांतर).
- Continuation in the promoted position is contingent upon favorable service review outcome.
Condition 3: Computer Proficiency & Language Examination Certificates
- The Commissioner, State Excise Office must verify and confirm that the promoted officers possess:
- Computer Aptitude Test Certificate (सांगणक अहशता परीक्षा)
- Marathi Language Examination Certificate — either exemption/waiver OR passed status (मराठी भाषा परीक्षा सूट/उत्तीणश)
- Hindi Language Examination Certificate — either exemption/waiver OR passed status (हहदी भाषा परीक्षा सूट/उत्तीणश)
- The Commissioner must ensure all necessary records are maintained regarding these qualifications.
Condition 4: Domicile Certificate Verification
- The Commissioner, State Excise Office must verify and confirm that each promoted officer has obtained and possesses a valid Domicile Benefit Certificate (स्थावयत्ि लाभ प्रमाणपत्र).
Condition 5: Powers & Responsibilities Handover
- Each promoted officer must obtain and sign the Statement of Powers and Responsibilities (मत्ता ि दावयत्िाची वििरणपत्रे) before assuming charge of the new position.
3. IMMEDIATE POSTING & ASSUMPTION OF CHARGE:
- The order is effective immediately from the date of the order (13 September 2019).
- The promoted officers are relieved from their current positions effective from the date of this order (सदर अवधकाऱ्याांना या आदेशाच्या वदनाांकापासून कायशमुक्त करण्यात येत आहे).
- Each officer must immediately proceed to their new posting location and assume charge of the promoted position without delay (तात्काळ हजर होउन पदाचा कायशभार घ्यािा).
- The transfer must be completed within the prescribed time period (विहीत कालािधीमध्ये).
4. CONSEQUENCES OF NON-COMPLIANCE WITH POSTING:
- If a promoted officer fails to report to the new posting location within the prescribed time period, disciplinary action shall be initiated against that officer (वशस्तभांगविषयक कारिाई करण्यात येईल).
- Non-joining within the prescribed timeline is treated as a breach of discipline.
5. PROHIBITION ON INTERFERENCE & ANTI-INFLUENCE CLAUSE:
- No officer — directly or indirectly — may attempt to exert pressure, undue influence, or interference to seek modification or alteration of this order.
- Any such attempt is considered a violation of Rule 23 of the Maharashtra Civil Service (Conduct) Rules, 1979 (महाराष्ट्र नागरी सेिा (ितशणूक) वनयम, 1979 मधील वनयम 23).
- Violation of this clause constitutes misconduct (गैरितशणूक) and shall trigger disciplinary proceedings against the officer attempting such interference.
