In exercise of the powers conferred by sub-section (I) of section 143 of the Bombay Prohibition Act, 1949 (Bom. XXV of 1949), and of all other powers enabling it in that behalf, the Government of Maharasthra hereby makes the following Rules, the same having been previsously published as required by sub-section (3) of the said section 143:
मुंबई दारूबंदी अधिनियम, १९४९ (मुंबई अधिनियम XXV सन १९४९) च्या कलम १४३ च्या उपकलम (१) द्वारे प्रदान केलेल्या अधिकारांचा आणि त्या संबंधात समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे पुढील नियम करीत आहे, ते सदर कलम १४३ च्या उपकलम (३) अन्वये आवश्यकतेनुसार पूर्वप्रसिद्ध करण्यात आलेले आहेत :
Short title शीर्षक
These Rules may be called the Bombay Prohibition (Mhowra Flowers) (Prescribed Limit in Weight) Rules, 1963.
या नियमांस मुंबई दारूबंदी (म्हवराची फुले) (विहित वजन मर्यादा) नियम, १९६३ असे संबोधण्यात येईल.
Limit for purposes of section 60 (2) कलम ६० (२.) च्या उद्देशांसाठी मर्यादा
The prescribed limit in weight for the purpose of sub-section (2) of section 60 of the Act shall be five kilograms :
अधिनियमाच्या कलम ६० च्या उपकलम (२) च्या प्रयोजनार्थ वजनाची विहित मर्यादा पाच किलोग्रॅम असेल :
2 [Provided that, such prescribed limit shall be twenty-five kilograms in respect of tribals residing in the tribal areas of the State specified in column 2 of the Schedule hereto annexed and who distill or brew their own local traditional drinks from Mhowra Flowers, specified in column 3 thereof, for the purpose of consumption, use or offering or distribution of the liquor for mutual accommodation for personal and social purposes but not for commercial purpose:
परंतु, याला जोडलेल्या अनुसूचीच्या स्तंभ २ मध्ये विनिर्दिष्ट केलेल्या राज्याच्या आदिवासी क्षेत्रात राहणाऱ्या आणि त्यातील स्तंभ ३ मध्ये विनिर्दिष्ट केलेल्या म्हवराच्या फुलांपासून स्वतःची स्थानिक पारंपरिक पेये तयार करणाऱ्या आदिवासींच्या संबंधात अशी विहित मर्यादा पंचवीस किलोग्रॅम असेल, जी सेवन, वापर किंवा वैयक्तिक व सामाजिक प्रयोजनांसाठी परस्पर सामंजस्यासाठी मद्याचे वाटप करण्याच्या उद्देशाने असेल, परंतु व्यापारी प्रयोजनार्थ नसेल :
Provided further that, if any such tribal possesses Mhowra Flowers more than twenty-five kilograms but not exceeding seventy-five kilograms he shall make a declaration of the exact quantity passed by him to the Gram-Panchayat of his village
तसेच परंतु, अशा कोणत्याही आदिवासीकडे पंचवीस किलोग्रॅमपेक्षा जास्त परंतु पंचाहत्तर किलोग्रॅमपेक्षा अधिक नसलेली म्हवराची फुले असल्यास, त्याने त्याच्या गावच्या ग्रामपंचायतीला त्याच्याकडे असलेल्या अचूक प्रमाणाची घोषणा करावी.
Provided that, in respect of tribal residing in tribal areas of the Stale specified in column (2) of the Schedule hereto annexed and who distil or brew their own local traditional drinks from Mhowra flowers, specified in column (3) thereof, for the purpose of consumption, use of offering, or distribution of liquor for mutual accommodation for personal and social purposes but not for commercial purpose, no license, permit or pass shall be necessary for the collection purpose, transport, sale or possession of any quantity of Mhowra flowers.
परंतु, याला जोडलेल्या अनुसूचीच्या स्तंभ (२) मध्ये विनिर्दिष्ट केलेल्या राज्याच्या आदिवासी क्षेत्रात राहणाऱ्या आणि त्यातील स्तंभ (३) मध्ये विनिर्दिष्ट केलेल्या म्हवराच्या फुलांपासून सेवन, अर्पण किंवा वैयक्तिक व सामाजिक प्रयोजनांसाठी परस्पर सामंजस्यासाठी मद्याचे वाटप करण्याच्या उद्देशाने स्वतःची स्थानिक पारंपरिक पेये तयार करणाऱ्या आदिवासींच्या संबंधात, म्हवराच्या फुलांच्या कोणत्याही प्रमाणाच्या संकलन, वाहतूक, विक्री किंवा कब्जासाठी कोणताही परवाना, अनुज्ञापत्र किंवा पास आवश्यक नसेल.
