Whereas the Government of Maharashtra considers to make the Maharashtra Gram Rakshak Dal Rules, should be brought into force at once, and therefore the rules should be made without previous publication as provided by the proviso to sub-section (3) of section 143 of the Maharashtra Prohibition Act (XXV of 1949);
Now, therefore, in exercise of the powers conferred by clauses (x), (y) and (z) of sub-section (2) read with the proviso to sub-section (3) of section 143 of the Bombay Prohibition Act, 1949 and of all other powers enabling it in that behalf, the Government of Maharashtra hereby makes the following rules, namely :-
📋 AT A GLANCE: These Rules govern the formation, composition, powers, and operational procedures of Gram Rakshak Dal units established to detect and report illicit liquor production, possession, and sale at the village level under the Maharashtra Prohibition Act, 1949. The Rules specify member eligibility, selection processes, duties, and coordination between Dal units and excise authorities for maintaining prohibition compliance at the grassroots level.

महाराष्ट्र शासन महाराष्ट्र ग्राम रक्षक दल नियम बनवून ते तात्काळ अंमलात आणण्याचा विचार करीत असल्याने, आणि म्हणून महाराष्ट्र दारूबंदी अधिनियम (XXV, १९४९) च्या कलम १४३ च्या उप-कलम (३) च्या परंतुकानुसार पूर्वप्रसिद्धीशिवाय नियम बनवावेत;
आता, म्हणून, मुंबई दारूबंदी अधिनियम, १९४९ च्या कलम १४३ च्या उप-कलम (२) च्या खंड (क्ष), (य) आणि (झ) च्या तरतुदी उप-कलम (३) च्या परंतुकासह वाचून आणि त्या संबंधी इतर सर्व सक्षम अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे खालील नियम बनवीत आहे, म्हणजे :-
Short Title शीर्षक
Short Title.- These rules may be called the Maharashtra Gram Rakshak Dal Rules, 2017.
शीर्षक.- या नियमांना महाराष्ट्र ग्राम रक्षक दल नियम, २०१७ असे म्हणता येईल.
Definitions व्याख्या
In these rules, unless the context otherwise requires,-
(a) "Act" means the Maharashtra Prohibition Act (XXV of 1949) ;
(b) "application" means a representation submitted by women voters of the Gram Sabha to Sub-Divisional Magistrate ;
(c) "Form" means the Forms appended to these rules ;
(d) "Gram Sabha" means the Gram Sabha as defined in clause (9) of Section 3 of the Maharashtra Village Panchayats Act, 1958 ;
(e) "Gramsevak" means the secretary to the Panchayat as defined in sub-section (20) of section 3 of the Maharashtra Village Panchayat Act, 1958 ;
(f) "Sub-Divisional Magistrate", "Tahsildar" and "Talathi" means the officers mentioned in the Maharashtra Land Revenue Code, 1966.
Words and expressions used in these rules but not defined in these rules shall have meanings respectively assigned to them in the Act.
या नियमांमध्ये, संदर्भानुसार अन्यथा आवश्यक नसल्यास,-
(अ) "अधिनियम" म्हणजे महाराष्ट्र दारूबंदी अधिनियम (XXV, १९४९);
(ब) "अर्ज" म्हणजे ग्रामसभेतील महिला मतदारांनी उप-विभागीय दंडाधिकाऱ्यांना सादर केलेले निवेदन;
(क) "नमुना" म्हणजे या नियमांना जोडलेले नमुने;
(ड) "ग्रामसभा" म्हणजे महाराष्ट्र ग्रामपंचायत अधिनियम, १९५८ च्या कलम ३ च्या खंड (९) मध्ये व्याख्या केल्यानुसार ग्रामसभा;
(इ) "ग्रामसेवक" म्हणजे महाराष्ट्र ग्रामपंचायत अधिनियम, १९५८ च्या कलम ३ च्या उप-कलम (२०) मध्ये व्याख्या केल्यानुसार पंचायतीचा सचिव;
(फ) "उप-विभागीय दंडाधिकारी", "तहसीलदार" आणि "तलाठी" म्हणजे महाराष्ट्र जमीन महसूल संहिता, १९६६ मध्ये नमूद केलेले अधिकारी.
या नियमांमध्ये वापरलेल्या परंतु व्याख्या न केलेल्या शब्दांना आणि अभिव्यक्तींना अधिनियमात अनुक्रमे दिलेले अर्थ असतील.
Procedure for filing representation by Gram Panchayat and Women Voters ग्रामपंचायत व महिला मतदारांद्वारे प्रतिनिधित्व दाखल करण्याची प्रक्रिया
If Village Panchayat decides to establish a Gram Rakshak Dal in a village, as provided in sub-section (1) of section 134A, shall apply in Form-A appended to the rules, to the Sub-Divisional Magistrte along with a copy of the Resolution passed by the Panchayat, to convey a special meeting of Gram Sabha, for establishment of the Gram Rakshak Dal in the Village.
If the Women of the Village decides to establish a Gram Rakskak Dal in a village provided in sub-section (1) of section 134A, shall apply in Form-B appended to the rules, to Sub-Divisional Magistrate to convey a special meeting of the Gram Sabha, for establishment of the Gram Rakshak Dal in the Village.
The Gramsevak shall forward the application received, to the Sub-Divisional Magistrate.
कलम १३४-अ च्या उप-कलम (१) मध्ये तरतूद केल्यानुसार, ग्रामपंचायतीने गावात ग्राम रक्षक दल स्थापन करण्याचा निर्णय घेतल्यास, पंचायतीने मंजूर केलेल्या ठरावाच्या प्रतीसह, गावात ग्राम रक्षक दल स्थापन करण्यासाठी ग्रामसभेची विशेष बैठक बोलावण्यासाठी, नियमांना जोडलेल्या नमुना-अ मध्ये उप-विभागीय दंडाधिकाऱ्यांकडे अर्ज करावा.
कलम १३४-अ च्या उप-कलम (१) मध्ये तरतूद केल्यानुसार, गावातील महिलांनी गावात ग्राम रक्षक दल स्थापन करण्याचा निर्णय घेतल्यास, गावात ग्राम रक्षक दल स्थापन करण्यासाठी ग्रामसभेची विशेष बैठक बोलावण्यासाठी, नियमांना जोडलेल्या नमुना-ब मध्ये उप-विभागीय दंडाधिकाऱ्यांकडे अर्ज करावा.
ग्रामसेवकाने प्राप्त झालेला अर्ज उप-विभागीय दंडाधिकाऱ्यांकडे पाठवावा.
Sub-Divisional Magistrate to convene special meeting of the Gram Sabha when application received under rule 3(1) नियम 3(1) अन्वये अर्ज प्राप्त झाल्यावर उपविभागीय दंडाधिकारी ग्रामसभेची विशेष सभा बोलावतील.
When an application under sub-rule (1) of rule 3 is received, for establishment of the Gram Rakshak Dal in a village, the Sub-Divisional Magistrate shall direct the Tahsildar to convene a special meeting of the Gram Sabha of that village within a month.
The Tahsildar shall decide the date and time of the special Gram Sabha in consultation with the Gram Panchayat.
In the special Gram Sabha, if it is decided by more than 225 per cent of the total voters to establish a Gram Rakshak Dal, the Gram Sabha shall select the members of the Gram Rakshak Dal.
1Provided that, if in the meeting of the Special Gram Sabha, the Gram Rakshak Dal is not established, then Gram Rakshak Dal shall be established in the meeting of the next Gramsabha.
गावात ग्राम रक्षक दल स्थापन करण्यासाठी नियम ३ च्या उप-नियम (१) अन्वये अर्ज प्राप्त झाल्यावर, उप-विभागीय दंडाधिकाऱ्यांनी तहसीलदारांना एक महिन्याच्या आत त्या गावाच्या ग्रामसभेची विशेष बैठक बोलावण्याचे निर्देश द्यावेत.
तहसीलदारांनी ग्रामपंचायतीशी सल्लामसलत करून विशेष ग्रामसभेची तारीख आणि वेळ निश्चित करावी.
Verification of application of Women voters महिला मतदारांच्या अर्जाची पडताळणी
Verification of application of Women voters.- When an application by Women voters as provided in sub-rule (2) of rule 3, is received to the Sub-Divisional Magistrate for establishment of the Gram Rakshak Dal in a village, the Sub-Divisional Magistrate shall direct the Tahsildar to verify signatures of the Women voters. The Tahsildar shall verify signatures on application with the name in the voter's list with the help of Gramsevak and concerned Talathi of the village. After verification of the fact that such application is filed by not less than 25 per cent. of the Women voters out of the total Women voters of the village, the Tahsildar shall submit the verification report to the Sub-Divisional Magistrate.
महिला मतदारांच्या अर्जाची पडताळणी.- नियम ३ च्या उप-नियम (२) मध्ये तरतूद केल्यानुसार गावात ग्राम रक्षक दल स्थापन करण्यासाठी महिला मतदारांचा अर्ज उप-विभागीय दंडाधिकाऱ्यांना प्राप्त झाल्यावर, उप-विभागीय दंडाधिकाऱ्यांनी तहसीलदारांना महिला मतदारांच्या स्वाक्षऱ्यांची पडताळणी करण्याचे निर्देश द्यावेत. तहसीलदारांनी ग्रामसेवक आणि गावातील संबंधित तलाठी यांच्या मदतीने अर्जावरील स्वाक्षऱ्यांची मतदार यादीतील नावांशी पडताळणी करावी. गावातील एकूण महिला मतदारांपैकी किमान २५ टक्के महिला मतदारांनी असा अर्ज दाखल केल्याच्या वस्तुस्थितीची पडताळणी केल्यानंतर, तहसीलदारांनी पडताळणी अहवाल उप-विभागीय दंडाधिकाऱ्यांना सादर करावा.
Sub-Divisional Magistrate to convene special meeting of Women’s Gram Sabha when application received under rule 3(2) नियम ३(२) अन्वये अर्ज प्राप्त झाल्यावर उपविभागीय दंडाधिकारी महिला ग्रामसभेची विशेष बैठक बोलावतील.
After receipt of the report of the Tahsildar under rule 5, the Sub-Divisional Magistrate shall direct the Tahsildar to convene a special meeting of the Women's Gram Sabha of that village within a month, if the verification report is favourable.
The Tahsildar shall decide the date and time of the special Women's Gram Sabha in consultation with the Gram Panchayat.
If in a Women's Gram Sabha it is decided by more than 225 per cent of the total Women voters to establish a Gram Rakshak Dal in a village, the Women's Gram Sabha shall select the members of Gram Rakshak Dal. If it is decided to appoint male members as members of Gram Rakshak Dal the consent of the member shall be required.
1Provided that, if in the meeting of the Women Special Gram Sabha, the Gram Rakshak Dal is not established, then Gram Rakshak Dal shall be established in the meeting of the next Gramsabha.
नियम ५ अन्वये तहसीलदारांचा अहवाल प्राप्त झाल्यानंतर, पडताळणी अहवाल अनुकूल असल्यास, उप-विभागीय दंडाधिकाऱ्यांनी तहसीलदारांना एक महिन्याच्या आत त्या गावाच्या महिला ग्रामसभेची विशेष बैठक बोलावण्याचे निर्देश द्यावेत.
तहसीलदारांनी ग्रामपंचायतीशी सल्लामसलत करून विशेष महिला ग्रामसभेची तारीख आणि वेळ निश्चित करावी.
महिला ग्रामसभेत एकूण महिला मतदारांपैकी 2२५ टक्क्यांपेक्षा अधिक मतदारांनी गावात ग्राम रक्षक दल स्थापन करण्याचा निर्णय घेतल्यास, महिला ग्रामसभा ग्राम रक्षक दलाच्या सदस्यांची निवड करेल. पुरुष सदस्यांना ग्राम रक्षक दलाचे सदस्य म्हणून नियुक्त करण्याचा निर्णय घेतल्यास सदस्याची संमती आवश्यक असेल.
1तथापि, महिला विशेष ग्रामसभेच्या बैठकीत ग्राम रक्षक दल स्थापन न झाल्यास, पुढच्या महिला ग्रामसभेत ग्राम रक्षक दल स्थापन केले जाईल.
Establishment of Gram Rakshak Dal ग्राम रक्षक दलाची स्थापना
Establishment of Gram Rakshak Dal.-
(1) There shall be video shooting of such Gram Sabha and said shooting shall be used as evidence.
(2) As provided in rules 4 and 6, the names of the members of Gram Rakshak Dal selected in the special Gram Sabha, the Tahsildar shall send such names to the Sub-Divisional Magistrate and other details.
(3) The Sub-Divisional Magistrate shall obtain, the antecedent reports from the police station of the recommended members. The Sub-Divisional Magistrate shall after verifying the detalis about the selected members issue the order to establish a Gram Rakshak Dal in the village.
(4) The Tahsildar shall issue Identity cards to selected members of the Gram Rakshak Dal. The identity card shall be returned back once the tenure of the member ends.
ग्राम रक्षक दलाची स्थापना.-
(१) अशा ग्रामसभेचे व्हिडिओ चित्रीकरण करावे आणि सदर चित्रीकरण पुरावा म्हणून वापरले जाईल.
(२) नियम ४ आणि ६ मध्ये तरतूद केल्यानुसार, विशेष ग्रामसभेत निवडलेल्या ग्राम रक्षक दलाच्या सदस्यांची नावे आणि इतर तपशील तहसीलदारांनी उप-विभागीय दंडाधिकाऱ्यांना पाठवावेत.
(३) उप-विभागीय दंडाधिकाऱ्यांनी शिफारस केलेल्या सदस्यांचे पूर्ववृत्त अहवाल पोलीस ठाण्याकडून प्राप्त करावेत. निवडलेल्या सदस्यांबद्दलचा तपशील पडताळल्यानंतर उप-विभागीय दंडाधिकाऱ्यांनी गावात ग्राम रक्षक दल स्थापन करण्याचा आदेश जारी करावा.
(४) तहसीलदारांनी ग्राम रक्षक दलाच्या निवडलेल्या सदस्यांना ओळखपत्र द्यावे. सदस्याचा कार्यकाळ संपल्यानंतर ओळखपत्र परत करावे.
Duties of Gramsevak and Talathi ग्रामसेवक व तलाठ्यांची कर्तव्ये
Duties of Gramsevak and Talathi.- The Gramsevak and Talathi shall assist the Tahsildar for establishment of the Gram Rakshak Dal and all works for the purposes of these rules.
ग्रामसेवक व तलाठ्यांची कर्तव्ये.- ग्रामसेवक आणि तलाठी यांनी ग्राम रक्षक दल स्थापन करण्यासाठी आणि या नियमांच्या प्रयोजनार्थ सर्व कामांसाठी तहसीलदारांना सहाय्य करावे.
Measures and precautions to be taken during Special Gram Sabha विशेष ग्रामसभेच्या वेळी करावयाच्या उपाययोजना व खबरदारी
The voters gathered for the Special Gram Sabha should be identified ensuring their names in the electroal rolls and then be given access to Gram Sabha.
No person who is not a voter of that village should be allowed to enter the Special Gram sabha.
The Tahsildar shall put before the Gram Sabha the purpose of convening the meeting and address to the Gram Sabha, explaining the intention of the provisions of the Act and that of the rules to establish Gram Rakshak Dal. The Tahsildar shall instruct the voters to suggest the names of the members to establish Gram Rakshak Dal.
विशेष ग्रामसभेसाठी जमलेल्या मतदारांची मतदार यादीत त्यांची नावे आहेत याची खात्री करून ओळख पटवावी आणि त्यानंतर त्यांना ग्रामसभेत प्रवेश द्यावा.
त्या गावचा मतदार नसलेल्या कोणत्याही व्यक्तीला विशेष ग्रामसभेत प्रवेश दिला जाऊ नये.
तहसीलदारांनी ग्रामसभेसमोर बैठक बोलावण्याचा उद्देश मांडावा आणि ग्राम रक्षक दल स्थापन करण्यासाठी अधिनियमाच्या तरतुदी आणि नियमांचा हेतू स्पष्ट करून ग्रामसभेला संबोधित करावे. तहसीलदारांनी मतदारांना ग्राम रक्षक दल स्थापन करण्यासाठी सदस्यांची नावे सुचवण्यास सांगावे.
Eligibility criteria for appointing a member of Gram Rakshak Dal ग्राम रक्षक दलाच्या सदस्याची नियुक्ती करण्यासाठी पात्रता निकष
Eligibility criteria for appointing a member of Gram Rakshak Dal.-
(a) The person should be a voter of the village ;
(b) The person should have done appreciable work regarding prohibition ;
(c) The person should be a teetotaller ;
(d) No crime should have been registered against the person in the past under Indian Penal Code or any other Act in which provision of punishment is more than three years.
ग्राम रक्षक दलाच्या सदस्याची नियुक्ती करण्यासाठी पात्रता निकष.-
(अ) व्यक्ती गावचा मतदार असावा;
(ब) व्यक्तीने दारूबंदीबाबत उल्लेखनीय कार्य केलेले असावे;
(क) व्यक्ती मद्यत्यागी असावा;
(ड) भारतीय दंड संहिता किंवा इतर कोणत्याही अधिनियम ज्यात तीन वर्षांपेक्षा अधिक शिक्षेची तरतूद आहे त्यानुसार पूर्वी व्यक्तीविरुद्ध कोणताही गुन्हा दाखल झालेला नसावा.
Selection of members of Gram Rakshak Dal ग्राम रक्षक दलाच्या सदस्यांची निवड
Total number of members of Gram Rakshak Dal shall be equal to the number of members of that Village Panchayat, but the number of members in any case shall not be more than elevan.
The number of women members of the Gram Rakshak Dal shall not be less than one-third of the total members.
The Scheduled Castes and Scheduled Tribes category members should be in proportion to the population of such castes and tribes to the population of the village. If, no suitable member is available from these categories then members from other categories may be selected.
ग्राम रक्षक दलाच्या सदस्यांची एकूण संख्या त्या ग्रामपंचायतीच्या सदस्यसंख्येएवढी असेल, परंतु कोणत्याही परिस्थितीत सदस्यसंख्या अकरापेक्षा अधिक असणार नाही.
ग्राम रक्षक दलातील महिला सदस्यांची संख्या एकूण सदस्यसंख्येच्या एक-तृतीयांशपेक्षा कमी असणार नाही.
अनुसूचित जाती आणि अनुसूचित जमाती वर्गातील सदस्य गावाच्या लोकसंख्येच्या प्रमाणात अशा जाती आणि जमातींच्या लोकसंख्येनुसार असावेत. या वर्गातून कोणताही योग्य सदस्य उपलब्ध नसल्यास इतर वर्गातून सदस्य निवडले जाऊ शकतात.
Selection of Chairperson and Member-Secretary of Gram Rakshak Dal ग्राम रक्षक दलाचे अध्यक्ष व सदस्य-सचिव यांची निवड
In the first meeting of the Gram Rakshak Dal, the Chairperson and Member-Secretary shall be elected by majority from amongst the members.
The tenure of the Chairperson, Member-Secretary and member shall be co-terminus with the tenure of the Gram Rakshak Dal.
The resignation of the Chairperson shall be submitted to the Member-Secretary. The resignation of the Member-Secretary and member shall be submitted to the Chairperson.
The meeting of the Gram Rakshak Dal shall be conveyed at least once in three months.
If the members of the Gram Rakshak Dal decide to remove or appoint a new Chairperson of the Gram Rakshak Dal, may submit an application with signature of not less than three members to the Member-Secretary, with request to convene a Special meeting of the Gram Rakshak Dal. The members of the Gram Rakshak Dal shall select the Chairperson by majority.
It is mandatory to send the minutes of the meetings of the Gram Rakshak Dal to Sub-Divisional Magistrate, Police station and State Excise Department having jurisdiction over the village and to the Village Panchayat.
The Member-Secretary of the Gram Rakshak Dal shall keep the record of minutes of the meetings of the Gram Rakshak Dal in Form-C and other record of the Gram Rakshak Dal.
ग्राम रक्षक दलाच्या पहिल्या बैठकीत, सदस्यांमधून बहुमताने अध्यक्ष आणि सदस्य-सचिव निवडले जातील.
अध्यक्ष, सदस्य-सचिव आणि सदस्य यांचा कार्यकाळ ग्राम रक्षक दलाच्या कार्यकाळासह समाप्त होईल.
अध्यक्षांचा राजीनामा सदस्य-सचिवांना सादर करावा. सदस्य-सचिव आणि सदस्याचा राजीनामा अध्यक्षांना सादर करावा.
ग्राम रक्षक दलाची बैठक किमान तीन महिन्यांतून एकदा बोलावली जाईल.
ग्राम रक्षक दलाच्या सदस्यांनी ग्राम रक्षक दलाच्या अध्यक्षांना काढून टाकण्याचा किंवा नवीन अध्यक्ष नियुक्त करण्याचा निर्णय घेतल्यास, ग्राम रक्षक दलाची विशेष बैठक बोलावण्याच्या विनंतीसह किमान तीन सदस्यांच्या स्वाक्षरीने सदस्य-सचिवांना अर्ज सादर करू शकतात. ग्राम रक्षक दलाचे सदस्य बहुमताने अध्यक्ष निवडतील.
ग्राम रक्षक दलाच्या बैठकींचे इतिवृत्त गावावर अधिकारक्षेत्र असलेल्या उप-विभागीय दंडाधिकारी, पोलीस ठाणे आणि राज्य उत्पादन शुल्क विभाग आणि ग्रामपंचायतीला पाठवणे अनिवार्य आहे.
ग्राम रक्षक दलाच्या सदस्य-सचिवांनी ग्राम रक्षक दलाच्या बैठकींच्या इतिवृत्तांची नोंद नमुना-क मध्ये आणि ग्राम रक्षक दलाच्या इतर अभिलेखांची नोंद ठेवावी.
Tenure of Gram Rakshak Dal and procedure to appoint new member and resignation of member ग्राम रक्षक दलाचा कार्यकाळ आणि नवीन सदस्य नेमण्याची पद्धत आणि सदस्याचा राजीनामा
The term of Gram Rakshak Dal and its members shall be for two years from the date of issue of the order.
After establishment of the Gram Rakshak Dal, if, there is demand to remove any member from Gram Rakshak Dal, such member may be removed by passing a resolution in Gram Sabha by 51 per cent. of the total voters or 51 per cent. of Women total voters in favour of the resolution. The resolution shall be sent to the Sub-Divisional Magistrate. The Sub-Divisional Magistrate shall remove such member from the Gram Rakshak Dal.
The member of the Gram Rakshak Dal may submit his resignation to the Sub-Divisional Magistrate, who shall on verification accept it after due verification.
If any member is convicted in any offence, he shall automatically cease to be a member of the Gram Rakshak Dal. The Member-Secretary shall inform the same to the Sub-Divisional Magistrate.
The Vacancy of the Gram Rakshak Dal shall be filled in by passing a resolution by majority in the Gram Sabha. The recommended name shall be forwarded to the Sub-Divisional Magistrate. The Sub-Divisional Magistrate shall appoint such person as the member of the Gram Rakshak Dal. The new member shall be appointed for remaining term of the Gram Rakshak Dal.
If a member does not attend three consecutive meetings of the Gram Rakshak Dal, without sufficient cause, then the Member-Secretary may recommend to the Sub-Divisional Magistrate to remove such member as the member of the Gram Rakshak Dal. The Sub-Divisional Magistrate shall take the decision to remove the concerned member, only after satisfying himself of the reasons and after giving him a reasonable opportunity of being heard.
ग्राम रक्षक दल आणि त्याच्या सदस्यांचा कार्यकाळ आदेश जारी तारखेपासून दोन वर्षांचा असेल.
ग्राम रक्षक दल स्थापन झाल्यानंतर, ग्राम रक्षक दलातून कोणत्याही सदस्याला काढून टाकण्याची मागणी असल्यास, ठरावाच्या बाजूने एकूण मतदारांपैकी ५१ टक्के किंवा एकूण महिला मतदारांपैकी ५१ टक्के मतदारांनी ग्रामसभेत ठराव मंजूर करून असा सदस्य काढून टाकला जाऊ शकतो. ठराव उप-विभागीय दंडाधिकाऱ्यांना पाठवावा. उप-विभागीय दंडाधिकाऱ्यांनी अशा सदस्याला ग्राम रक्षक दलातून काढून टाकावे.
ग्राम रक्षक दलाचा सदस्य आपला राजीनामा उप-विभागीय दंडाधिकाऱ्यांना सादर करू शकतो, जे योग्य पडताळणीनंतर तो स्वीकारतील.
कोणत्याही सदस्यास कोणत्याही गुन्ह्यात दोषी ठरवले गेल्यास, तो स्वयंचलितपणे ग्राम रक्षक दलाचा सदस्य राहणार नाही. सदस्य-सचिवांनी याबाबत उप-विभागीय दंडाधिकाऱ्यांना कळवावे.
ग्राम रक्षक दलातील रिक्त जागा ग्रामसभेत बहुमताने ठराव मंजूर करून भरली जाईल. शिफारस केलेले नाव उप-विभागीय दंडाधिकाऱ्यांना पाठवले जाईल. उप-विभागीय दंडाधिकारी अशा व्यक्तीला ग्राम रक्षक दलाचा सदस्य म्हणून नियुक्त करतील. नवीन सदस्य ग्राम रक्षक दलाच्या उर्वरित कार्यकाळासाठी नियुक्त केला जाईल.
सदस्याने पुरेशा कारणाशिवाय ग्राम रक्षक दलाच्या सलग तीन बैठकांना हजर न राहिल्यास, सदस्य-सचिव अशा सदस्याला ग्राम रक्षक दलाच्या सदस्यपदावरून काढून टाकण्यासाठी उप-विभागीय दंडाधिकाऱ्यांना शिफारस करू शकतात. उप-विभागीय दंडाधिकारी कारणांची स्वतः खात्री करून आणि संबंधित सदस्यास सुनावणीची वाजवी संधी दिल्यानंतरच संबंधित सदस्यास काढून टाकण्याचा निर्णय घेतील.
Duties and responsibilities of members of the Gram Rakshak Dal ग्राम रक्षक दलाच्या सदस्यांची कर्तव्ये व जबाबदाऱ्या
Duties and responsibilities of members of the Gram Rakshak Dal.- The members of the Gram Rakshak Dal shall,—
(a) inform the Police and the State Excise Department in writing about the illegal manufacture, transport, possession and sale of liquor in the village ;
(b) prevent persons from causing and creating nuisance in public due to liquor consumption, counselling such persons or give written warning to such persons by signatures of at least three members of the Gram Rakshak Dal ;
(c) arrange programmes to curb the addiction, educate such people and create awareness about the adverse effects of alcoholism ;
(d) after intimation from the officers of the State Police Department or State Excise Department, co-operate in the legal proceeding and shall remain present as a Panch/Witness in the case.
ग्राम रक्षक दलाच्या सदस्यांची कर्तव्ये व जबाबदाऱ्या.- ग्राम रक्षक दलाच्या सदस्यांनी,—
(अ) गावातील मद्याच्या बेकायदेशीर उत्पादन, वाहतूक, बाळगणे आणि विक्री याबद्दल पोलीस आणि राज्य उत्पादन शुल्क विभागाला लेखी कळवावे;
(ब) मद्यसेवनामुळे सार्वजनिक ठिकाणी उपद्रव निर्माण करणाऱ्या व्यक्तींना प्रतिबंध करावा, अशा व्यक्तींना समुपदेशन करावे किंवा ग्राम रक्षक दलाच्या किमान तीन सदस्यांच्या स्वाक्षरीने अशा व्यक्तींना लेखी इशारा द्यावा;
(क) व्यसनमुक्तीसाठी कार्यक्रम आयोजित करावेत, अशा लोकांना शिक्षित करावे आणि मद्यपानाच्या दुष्परिणामांबद्दल जागरूकता निर्माण करावी;
(ड) राज्य पोलीस विभाग किंवा राज्य उत्पादन शुल्क विभागाच्या अधिकाऱ्यांकडून सूचना मिळाल्यानंतर, कायदेशीर कार्यवाहीत सहकार्य करावे आणि प्रकरणात पंच/साक्षीदार म्हणून उपस्थित राहावे.
Review of Gram Rakshak Dal working ग्राम रक्षक दलाच्या कामकाजाचा आढावा
The Taluka level committee constituted by the Governement Resolution, Home Department, No.CRM.2004/608/Pol-11, dated the 23rd December 2005, for prohibition of illegal liquor shall convene a quarterly review meeting of the Gram Rakshak Dal. The Chairperson and the Member Secretary shall attend such meeting. The Tahsildar, Police Inspector and State Exicse officer shall coordinate the review meeting and submit its report to the Sub-Divisional Magistrate.
The Member-Secretary shall maintain the Register of Preventive Measures, collect information regarding illegal/illicit liquor, classification of information, storage of records and such other works.
बेकायदेशीर मद्य प्रतिबंधासाठी शासन निर्णय, गृह विभाग, क्र.सीआरएम.२००४/६०८/पोल-११, दिनांक २३ डिसेंबर २००५ अन्वये गठित तालुकास्तरीय समितीने ग्राम रक्षक दलाची त्रैमासिक आढावा बैठक बोलवावी. अध्यक्ष आणि सदस्य-सचिवांनी अशा बैठकीला उपस्थित राहावे. तहसीलदार, पोलीस निरीक्षक आणि राज्य उत्पादन शुल्क अधिकारी आढावा बैठकीचे समन्वय करतील आणि त्याचा अहवाल उप-विभागीय दंडाधिकाऱ्यांना सादर करतील.
सदस्य-सचिवांनी प्रतिबंधात्मक उपाययोजनांची नोंदवही ठेवावी, बेकायदेशीर/अवैध मद्याबद्दल माहिती गोळा करावी, माहितीचे वर्गीकरण करावे, अभिलेख साठवावेत आणि इतर अशा प्रकारची कामे करावीत.
