Title शीर्षक
These Rules may be called the Bombay Medicinal and Toilet Preparations (Use of Liquor) Rules, 1955.
या नियमांना मुंबई औषधी आणि सौंदर्यप्रसाधन तयारी (मद्याचा वापर) नियम, १९५५ असे संबोधले जाऊ शकते.
Definitions व्याख्या
(1) In these rules unless there is anything repugnant in the subject or context,—
- "Act" means the Bombay Prohibition Act, 1949;
- "Form" means a form appended to these rules;
- "Licence" means a licence granted under rule 4;
- "Licensed premises" means the premises in respect of which a licence is granted under rule 4;
- "Licensee" means a person holding a licence under these rules.
(2) Words and expressions not defined in these rules shall have the meanings respectively assigned to them in the Act.
(१) या नियमांमध्ये विषय किंवा संदर्भात विरोधाभासी काही नसल्यास,—
- "अधिनियम" म्हणजे मुंबई दारूबंदी अधिनियम, १९४९;
- "नमुना" म्हणजे या नियमांना जोडलेला नमुना;
- "परवाना" म्हणजे नियम ४ अन्वये मंजूर केलेला परवाना;
- "परवाना प्राप्त जागा" म्हणजे ज्या जागेच्या संदर्भात नियम ४ अन्वये परवाना मंजूर केला आहे;
- "परवानाधारक" म्हणजे या नियमांनुसार परवाना धारण करणारी व्यक्ती.
(२) या नियमांमध्ये व्याख्या न केलेल्या शब्दांना आणि अभिव्यक्तींना अधिनियमात त्यांना अनुक्रमे नियुक्त केलेले अर्थ असतील.
Application for Licence परवान्यासाठी अर्ज
Any person desiring to purchase, possess or use any liquor for the manufacture of any medicinal or toilet preparation whether fit or unfit for use as intoxicating liquor shall apply to the Collector for a licence in that behalf. The application shall contain the following particulars, namely:—
- Name and Address of the applicant;
- Kind and quantity of liquor required per month together with its name, if any;
- Kind of medicinal or toilet preparation or preparations for the manufacture of which the liquor is required together with the names of such preparation or preparations;
- Place where the liquor will be kept and used;
- Name and address of the person from whom the liquor is to be purchased and his licence number for the sale of liquor;
- The period for which the licence is required.
मादक मद्य म्हणून वापरण्यासाठी योग्य किंवा अयोग्य असलेली कोणतीही औषधी किंवा सौंदर्यप्रसाधन तयारी यांच्या उत्पादनासाठी कोणतेही मद्य खरेदी करण्याची, ताब्यात ठेवण्याची किंवा वापरण्याची इच्छा असणाऱ्या कोणत्याही व्यक्तीने त्या संदर्भात परवान्यासाठी जिल्हाधिकाऱ्यांकडे अर्ज करावा. अर्जात खालील तपशील असावेत, म्हणजे:—
- अर्जदाराचे नाव आणि पत्ता;
- दरमहा आवश्यक असलेल्या मद्याचा प्रकार आणि प्रमाण त्याच्या नावासह, जर असेल तर;
- ज्या औषधी किंवा सौंदर्यप्रसाधन तयारीच्या उत्पादनासाठी मद्य आवश्यक आहे त्याचा प्रकार त्या तयारी किंवा तयारींच्या नावांसह;
- मद्य कोठे ठेवले जाईल आणि वापरले जाईल;
- ज्या व्यक्तीकडून मद्य खरेदी करावयाचे आहे त्याचे नाव आणि पत्ता आणि मद्याच्या विक्रीसाठी त्याचा परवाना क्रमांक;
- ज्या कालावधीसाठी परवाना आवश्यक आहे.
Grant of Licence परवाना देणे
On receipt of the application, the Collector may make such inquiries as he deems necessary and if he is satisfied that there is no objection to grant the licence applied for, he may grant the applicant a licence in Form A on payment of the prescribed fee.
अर्ज मिळाल्यावर, जिल्हाधिकारी आवश्यक वाटेल अशी चौकशी करू शकतात आणि जर त्यांना समाधान झाले की अर्ज केलेला परवाना मंजूर करण्यास कोणताही हरकत नाही, तर ते विहित शुल्क भरल्यावर अर्जदाराला नमुना A मध्ये परवाना मंजूर करू शकतात.
Duration of Licence परवान्याचा कालावधी
(2) The licence may be renewed on application in that behalf accompanied by the prescribed fee.
(१) नमुना A मधील कोणताही परवाना तो सुरू होणाऱ्या तारखेनंतरच्या ३१ मार्च पलीकडील कालावधीसाठी मंजूर केला जाणार नाही.
(२) विहित शुल्कासह त्या संदर्भात अर्ज केल्यावर परवान्याचे नूतनीकरण केले जाऊ शकते.
Use or allow to be used the liquor मद्य वापर किंवा वापरण्यास परवानगी
The licensee shall not use or allow to be used the liquor purchased under the licence except at the licensed premises and only by himself or by his authorised agent or servant.
परवानाधारकाने परवान्याखाली खरेदी केलेल्या मद्याचा वापर करू नये किंवा वापरू देऊ नये फक्त परवाना प्राप्त जागेत आणि केवळ स्वतः किंवा त्याच्या अधिकृत एजंट किंवा नोकराद्वारे.
Purpose for which liquor to be used कोणत्या उद्देशासाठी दारू वापरावयाची
The licensee shall not use the liquor except for the purpose for which it is permitted to be used.
परवानाधारकाने मद्याचा वापर केवळ ज्या उद्देशासाठी वापरण्याची परवानगी आहे त्या उद्देशासाठी करावा.
Maintenance of Accounts and submission of monthly returns हिशोब ठेवणे व मासिक विवरणपत्रे सादर करणे
1[The licensee shall maintain day-to-day accounts in Form A-I of liquor purchased and used by him for the manufacture of medicinal or toilet preparations and shall submit before the 7th of every month to the local Superintendent of Prohibition and Excise or District Inspector of Prohibition and Excise, as the case may be, a return in Form A-II of liquor purchased and used by him in the preceding month for the manufacture of medicinal or toilet preparations.]

Licenced premises to be open for Inspection परवानाप्राप्त अनुज्ञप्ती निरीक्षणाकरिता खुले असेल
The licensed premises, the liquor kept therein and the accounts maintained in respect of such liquor shall at all times be open to inspection by any officer empowered under section 122 of the Act.
परवाना प्राप्त जागा, तेथे ठेवलेले मद्य आणि अशा मद्याच्या संदर्भात ठेवलेले हिशोब हे अधिनियमाच्या कलम १२२ अन्वये अधिकार प्राप्त असलेल्या कोणत्याही अधिकाऱ्याद्वारे सर्व वेळी तपासणीसाठी उघडे असतील.
Visit book भेट पुस्तिका
The licensee shall keep in his licensed premises a visit book paged and stamped with the seal of the Collector or any other officer authorised by him in this behalf in which visiting officers may record their remarks when inspecting the premises.
परवानाधारकाने त्याच्या परवाना प्राप्त जागेत जिल्हाधिकारी किंवा या संदर्भात त्यांनी अधिकृत केलेल्या इतर कोणत्याही अधिकाऱ्याच्या मुद्रेने मुद्रांकित आणि पाने असलेले एक भेट पुस्तक ठेवावे ज्यामध्ये भेट देणारे अधिकारी जागेची तपासणी करताना त्यांच्या शेरा नोंदवू शकतात.
Licencee shall be abide by the act, rules, regulation and orders made thereunder परवानाधारक अधिनियम, नियम, विनियम व आदेशांचे पालन करण्यास बांधील असेल
The licensee shall abide by the provisions of the Act and the rules, regulations and orders made thereunder and the conditions of the licence and shall give an undertaking to that effect.
परवानाधारकाने अधिनियम आणि त्यानुसार केलेले नियम, विनियम आणि आदेश आणि परवान्याच्या अटींचे पालन करावे आणि त्या आशयाचे प्रतिज्ञापत्र द्यावे.
Suspension or cancellation of licence अनुज्ञप्ती निलंबित किंवा रद्द होणे
The licence may be suspended or cancelled in accordance with the provisions of section 54 or 56 of the Act.
परवाना अधिनियमाच्या कलम ५४ किंवा ५६ च्या तरतुदींनुसार निलंबित किंवा रद्द केला जाऊ शकतो.
Surrender of stock in case of suspension, cancellation or not renewal of the licence परवाना निलंबित, रद्द झाल्यास किंवा नूतनीकरण न झाल्यास मद्यसाठा समर्पित करणे
In case the licence is suspended or cancelled during the currency of the licence period or is not renewed on its expiry, the licensee shall forthwith surrender to the Collector the whole of the unused stock of liquor.
परवान्याच्या कालावधीत परवाना निलंबित किंवा रद्द झाल्यास किंवा तो कालबाह्य झाल्यावर नूतनीकरण केले नाही तर, परवानाधारकाने तात्काळ मद्याचा संपूर्ण न वापरलेला साठा जिल्हाधिकाऱ्यांना समर्पित करावा.
Application for the transport pass of liquor मद्य वाहतूक पास साठी अर्ज
Transport. — Any licensee desiring to transport liquor required by him for the purpose mentioned in his licence shall make an application to the local Inspector of Prohibition and Excise for a pass in that behalf specifying the following particulars, namely:—
- Name and Address of the applicant;
- Name and number of his licence for the possession and use of liquor;
- Name, kind and quantity of liquor to be purchased;
- Place to which the liquor is to be transported;
- Route by which the liquor is to be transported;
- Period for which the licence is required to be valid.
वाहतूक. — त्याच्या परवान्यात नमूद केलेल्या उद्देशासाठी आवश्यक असलेल्या मद्याची वाहतूक करण्याची इच्छा असणाऱ्या कोणत्याही परवानाधारकाने त्या संदर्भात पाससाठी स्थानिक दारूबंदी आणि उत्पादन शुल्क निरीक्षकांकडे खालील तपशील नमूद करून अर्ज करावा, म्हणजे:—
- अर्जदाराचे नाव आणि पत्ता;
- मद्याच्या ताब्यात ठेवण्यासाठी आणि वापरासाठी त्याच्या परवान्याचे नाव आणि क्रमांक;
- खरेदी करावयाच्या मद्याचे नाव, प्रकार आणि प्रमाण;
- ज्या ठिकाणी मद्याची वाहतूक करावयाची आहे;
- ज्या मार्गाने मद्याची वाहतूक करावयाची आहे;
- ज्या कालावधीसाठी परवाना वैध राहावा असे आवश्यक आहे.
Grant of transport pass वाहतूक पास मंजूर करणे
On receipt of the application under rule 14, the Inspector shall make such inquiries as he deems necessary and if he is satisfied that there is no objection to grant the pass applied for, he may grant the applicant a pass in Form B. The pass shall be prepared in quadruplicate and one copy of it shall be retained by the Inspector on his record, one copy shall be handed over to the licensee to accompany the consignment, one copy shall be sent by post to the Excise authority of the place of purchase, and one copy shall be sent to the officer in charge of the check post or Superintendent of State Excise at the boundary of transit.
नियम १४ अन्वये अर्ज मिळाल्यावर, निरीक्षक आवश्यक वाटेल अशी चौकशी करतील आणि जर त्यांना समाधान झाले की अर्ज केलेला पास मंजूर करण्यास कोणताही हरकत नाही, तर ते अर्जदाराला नमुना B मध्ये पास मंजूर करू शकतात. पास चौपट तयार करावा आणि त्याची एक प्रत निरीक्षक त्याच्या नोंदीवर ठेवतील, एक प्रत परवानाधारकाला माल सोबत देण्यासाठी द्यावी, एक प्रत टपालाने खरेदीच्या ठिकाणच्या उत्पादन शुल्क प्राधिकाऱ्याकडे पाठवावी, आणि एक प्रत चेक पोस्टच्या प्रभारी अधिकारी किंवा संक्रमणाच्या सीमेवरील राज्य उत्पादन शुल्क अधीक्षक यांना पाठवावी.
No licence for the possession and use of rectified spirit or absolute alcohol if the licensee holds a valid licence or pass वैध परवाना किंवा पास असल्यास शुद्ध मद्यार्क किंवा पूर्ण मद्यार्क बाळगणे आणि वापरणे यासाठी कोणत्याही परवान्याची गरज नाही
No licence shall be granted under these rules for the possession and use of rectified spirit or absolute alcohol for the manufacture of any medicinal or toilet preparation. (Such use is governed by the Bombay Rectified Spirit (Transport in Bond) Rules, 1951 and related excise regime.)
कोणत्याही औषधी किंवा सौंदर्यप्रसाधन तयारीच्या उत्पादनासाठी शुद्ध मद्यार्क किंवा निरपेक्ष अल्कोहोल च्या ताब्यात ठेवण्यासाठी आणि वापरासाठी या नियमांनुसार कोणताही परवाना मंजूर केला जाणार नाही. (असा वापर मुंबई शुद्ध मद्यार्क (बंधपत्रातील वाहतूक) नियम, १९५१ आणि संबंधित उत्पादन शुल्क व्यवस्थेद्वारे नियंत्रित आहे.)
Provisions of these rules shall be addition to and not in derogation या नियमांच्या तरतुदी पूरक असून न्यूनीकरन करणारे नाही
The provisions of these rules shall be in addition to and not in derogation of any other law for the time being in force regulating the possession, use or sale of intoxicating liquor.
या नियमांच्या तरतुदी सध्या अंमलात असलेल्या मादक मद्याच्या ताब्यात ठेवणे, वापर किंवा विक्री यांचे नियमन करणाऱ्या इतर कोणत्याही कायद्याच्या व्यतिरिक्त असतील आणि त्यांच्या अवमूल्यनात नसतील.
