Made under clause (h) of sub-section (7) of Section 144 of the Bombay Prohibition Act, 1949.

Preamble text (verbatim): "In exercise of the powers conferred by clause (h) of sub-section (7) of Section 144 of the Bombay Prohibition Act, 1949 (Bom. XXV of 1949), and in supersession of the Commissioner of Excise, Bombay's Notification No. 81-6/39(c), dated the 13^th March, 1939, the Commissioner of Excise and Prohibition, Bombay is pleased to make the following regulations, namely:—"

Short title शीर्षक

These regulations may be called the Bombay Prohibition Intoxicants (Destruction) Regulations, 1954.

Rule 2 Current

Definitions व्याख्या

In these regulations, unless the context otherwise requires,—

(a)

(a) "Act" means the ¹[Bombay Prohibition Act, 1949 (Bom. XXV of 1949)];

(b)

(b) "licensed premises" means the premises in respect of which a licence has been issued under the Act.

Destruction of foreign liquor विदेशी दारूचा नाश

[Destruction of foreign liquor — content per printed manual page 1062-1063. All confiscated or forfeited potable foreign liquor shall be destroyed at the licensed premises or such other place as the Collector may direct, in the presence of the officers specified in Rule 5, and after such record of quantity, kind and strength as the Collector may require. Destruction of Neera निरेचा नाश करणे

Foreign liquor destruction on the presence विदेशी मद्य नाश कारतेवेळेसची उपस्थिती

Destruction shall be carried out in the presence of the Collector or officer authorised by him, along with the licensee (if applicable) or his representative. Compensation नुकसान भरपाई

Where a person's foreign liquor is destroyed but the confiscation is subsequently set aside on appeal, such compensation as the Collector may determine shall be payable to the person concerned, in accordance with the provisions of the Act. Destruction without prejudice to any proceedings कोणत्याही कार्यवाहीचा पूर्वग्रह न ठेवता नाश करणे

Nothing in these regulations shall affect the initiation, prosecution, or continuation of any proceedings under the Act in respect of the intoxicants, neera, or articles so destroyed.
