In exercise of the powers conferred by clauses (k), (!), (m) of sub-section (/) of section
139 of the Bombay Prohibition Act, 1949 (Bom. XXV of 1949), and of all other powers
enabling it in that behalf and in supersession of the Maharashtra Toddy Shops (Grant of
Licences by Auction or Tender) Order, 1968 and instruments thereunder the Government
of Maharashtra is pleased to make the following Order namely :-
मुंबई दारूबंदी अधिनियम, १९४९ (बॉम्. XXV of १९४९) च्या कलम १३९ च्या उपकलम (I) च्या खंड (k), (l), (m) द्वारा प्रदान केलेल्या शक्तींचा प्रयोग करून आणि त्या संबंधात सक्षम असलेल्या सर्व इतर शक्तींचा प्रयोग करून तसेच महाराष्ट्र तोडी दुकाने (परवाने लिलाव किंवा निविदेद्वारे प्रदान) आदेश, १९६८ आणि त्यांच्या अंतर्गत साधनांच्या निरसनार्थ महाराष्ट्र शासन खालील आदेश करण्यास प्रसन्न आहे, ते असे :-
संक्षिप्त शीर्षक - हा आदेश महाराष्ट्र तड्डी दुकान (लिलाव-सह-निविदा द्वारे परवाने प्रदान करणे) आदेश, २००१ असे संबोधित केला जाऊ शकतो।
"Act "means the @Bombay Prohibition Act, 1949 ;
auction " means the manner of inviting tenders as well as bids in public
auction for grant of licence for sale of Toddy ;
Auction authority " means the Collector or District Superintendent of the
State Excise of the District authorised by the collector to conduct auctions and
to call for tenders ;
" Auction Purchaser " means the person whose bid or tender is accepted by
the Auction Authority ;
bid " means an offer of bid money by bidder in an auction and includes a
tender ;
"bidder" means one who bids in an auction or makes an offer in tender ;
bid-money " means the consideration for the grant of licence under rule 4 of
the Maharashtra Toddy Shops (Licensing) and Toddy Trees (Tapping) Rules,
1968 payable by the purchaser comprising the licence fee ;
Commissioner" means Commissioner as defined under the Bombay
Prohibition Act, 1949
hall " means a place where auction shall be held ;
highest bidder " means the person who offers the highest bid-money by bid or
tender ;
" licence " means a licence granted in Form TD-1 under the Maharashtra Toddy
Shops (Licensing) and Toddy Trees (Tapping) Rules, 1968 ;
licensee " means a person who has been granted a licence under the
Maharashtra Toddy Shops (Licensing) and Toddy Trees (Tapping) Rules, 1968 ;
Licensing Authority " means the Collector ;
