Summary:

  • Such conduct constitutes violation of Maharashtra Civil Service (Conduct) Rules, 1979, Rule 23 and shall be treated as misconduct.
  • Disciplinary action shall be initiated against any officer engaging in such prohibited conduct.

Important Notes / Conditions / Penalties:

1. Mandatory Assumption of Duty: Officers must assume new postings immediately upon receipt of transfer orders. No discretion or delay permitted.

2. Compulsory Waiting Period Consequences: If an officer fails to report to the new posting, they may be placed on compulsory waiting period without being given work assignments, during which salary and allowances shall be paid. The responsible officer shall be held accountable.

3. Disciplinary Action for Obstruction: Any attempt (direct or indirect) to influence, pressure, or seek modification of the transfer order shall constitute:

   • Violation of Maharashtra Civil Service (Conduct) Rules, 1979, Rule 23
   • Classified as misconduct (गैर-वर्तणूक)
   • Subject to disciplinary proceedings against the officer concerned

4. No Exceptions for Personal Circumstances: The order does not permit exemptions or appeals on personal/family grounds. Once issued, the transfer is binding.

5. Handover-Takeover Requirements: The outgoing officer shall ensure proper handover of all records, files, and responsibilities. Until formal takeover, the outgoing officer remains responsible for pending matters.

6. Reporting Requirement: Commissioner, State Excise must report to the Government the exact dates of relief and assumption of duty for auditing and records purposes.

7. Digital Authentication: The order is valid and legally binding despite being issued in digital format with electronic signature (as per Government of India e-Governance standards).
