SUMMARY

This Government Resolution establishes a Suspension Review Committee at the departmental (administrative) level to review the suspension of Group-A and Group-B gazetted officers in the Maharashtra State Excise Department. The committee is constituted following prior GRs from the General Administration Department (14 October 2011 and 31 January 2015), which mandated that each administrative department form its own Suspension Review Committee under the chairmanship of its departmental secretary, rather than relying solely on the Chief Secretary-level committee. 1. Committee Constitution

The Suspension Review Committee for the Maharashtra State Excise Department is constituted as follows:

1. Chairperson: अपर मुख्य सचिव/प्रधान सचिव/सचिव (राउशु) [Additional Chief Secretary / Principal Secretary / Secretary (State Excise)] — Chairperson (अध्यक्ष)

2. Member: अतिरिक्त पोलीस महासंचालक, लाचलुचपत प्रतिबंधक विभाग [Additional Director General of Police, Anti-Corruption Bureau] — Member (सदस्य)

3. Member: उपसचिव/सहसचिव (पोल-2), गृह विभाग [Under Secretary / Joint Secretary (Police-2), Home Department] — Member (सदस्य)

4. Member-Secretary: उपसचिव/सहसचिव (राउशु), गृह विभाग [Under Secretary / Joint Secretary (State Excise), Home Department] — Member-Secretary (सदस्य सचिव)

2. Committee Jurisdiction and Functions

A. Primary Function (अ)

The committee shall review cases of suspended gazetted officers in the Maharashtra State Excise Department in accordance with the procedures laid out in Section-5 (पवरच्छेद-5) of the General Administration Department GR dated 31 January 2015.

B. Recommendations Authority (ब)

The committee shall submit its recommendations to the authority competent to suspend or recall the suspension of gazetted officers (i.e., the competent suspending authority).

C. Cases Related to Anti-Corruption/Criminal Proceedings (क)

The committee shall undertake a thorough examination of cases relating to:

1. Charge-sheet approval cases received from the Anti-Corruption Bureau (एंटी-करप्शन ब्यूरो)

2. Pending charge-sheet approval cases that have been pending for more than 90 days (90 दिवसापेक्षा जास्त कालावधीसाठी प्रलंवित)

3. Verification of whether reinstatement/appointment without suspension or with suspension of any officer involves appointment to a non-functional (अकार्यकारी) post

4. Action against employees convicted in anti-corruption or criminal proceedings (लाचलुचपत/फौजदारी प्रकरणात न्यायालयाने शिक्षा केलेल्या कर्मचाऱयांवर कारवाई करणे)

5. Direction to expedite disposal of affected officers' cases

D. Group-C and Group-D Officer Cases at Field Level (ड)

The committee shall conduct a monthly review of pending cases where charges are being filed against Group-C (गट-क) and Group-D (गट-ड) employees at the field/regional level (क्षेत्रीय स्तरावरील).

Reporting Requirements:

• Review to be conducted in the first week of each month (प्रत्येक महिन्याच्या पहिल्या आठवड्यात)
• Written report to be submitted to the Chief Secretary and Additional Chief Secretary, Home Department by the 10th of each month (प्रत्येक महिन्याच्या दहा तारखेपर्यंत)

Procedural Compliance

Scope of Review

• Cases involving officers with charge-sheets pending for 90+ days receive priority attention
• Particular scrutiny of cases involving reinstatement to non-functional posts
• Court-convicted officers in corruption/criminal cases subject to accelerated processing

Monthly Accountability

• For Group-C and Group-D officers: Monthly reporting mandatory — failure to report by the 10th of each month constitutes non-compliance
• Reports go to Chief Secretary and Additional Chief Secretary (Home Department)
