STATUTORY CONDITIONS ATTACHED TO PROMOTION:

Condition 1 — Temporary Nature:

Promotion shall remain temporary administrative promotion only; no permanent tenure rights are granted.

Condition 2 — No Permanent Tenure:

After promotion, the promoted officer shall have no permanent holding rights (Khaymi Dharandhikar) to the promoted position.

Condition 3 — No Service Seniority Rights:

Officers promoted from the 2015-16 promotion list shall not acquire any rights to:

• Regular position placement
• Service seniority (Seva Jyeshthata)

Condition 4 — Computer Competency Certification Mandatory:

The promoted officer must have cleared computer examination as per:

• M.N.S. (Computer Handling / Technical Knowledge) Rules, 1999, dated 25.01.1999
• Amendment Rules, 2018, dated 28.05.2018

The Commissioner, State Excise must provide written certification that the promoted officer has passed the computer examination.

Condition 5 — Maharashtra Public Service Commission Approval Mandatory:

The promotion from Office Superintendent (Group-A) to Assistant Commissioner (Group-B) remains subject to approval of the Maharashtra Public Service Commission (MPSC).

Condition 6 — No Departmental Inquiry Pending:

The promotion is granted under the presumption that no departmental inquiry of any nature against the promoted officer:

• Has commenced, OR
• Is proposed as of the date of this order.

The Commissioner, State Excise must certify this compliance.

Condition 7 — Backward Class Officer Reservation Compliance:

For officers promoted from backward/reserved categories:

• Promotion benefit granted under Government Resolution dated 25.05.2005 (Backward Class Reservation Policy)
• Officers must have not advanced beyond their original position in the seniority list due to reservation benefit
• Caste Validity Certificate (Jat Vaidhta Pramana-Patra) must have been issued by the relevant Caste Committee (Jat Padtalani Samiti)

The Commissioner, State Excise must certify this compliance.

Condition 8 — Mandatory Post-Promotion Training:

Under Maharashtra State Training Policy (Rashtriya Prashikshan Dhoron):

• The promoted officer is mandatorily required to undergo post-promotion training
• The Commissioner, State Excise shall arrange post-promotion training immediately
• The Commissioner must submit a report confirming completion of training

IMMEDIATE ACTION REQUIRED:

• Promoted Officer Action: Smt. Rekha Bhagwan Patil must:

• Formally accept the promotion
• Report immediately to the new posting at Assistant Commissioner (Divisional Deputy Commissioner), State Excise, Aurangabad

• Commissioner, State Excise Action:

1. Grant work release date to the promoted officer
2. Record the date the officer reports to new posting
3. Immediately inform the Government of:
   • Work release date granted
   • Actual date officer reported to new posting
4. Provide written certifications for:
   • Computer examination clearance (Condition 4)
   • No departmental inquiry status (Condition 6)
   • Backward class reservation compliance, if applicable (Condition 7)
5. Arrange and supervise post-promotion training (Condition 8)
6. Submit training completion report to Government
