3. Mandatory Compliance Instructions for Commissioner of State Excise

A) Release of Transferred Officers:

• Transferred officers must be released immediately upon receipt of the transfer order (बदलीबाबतचे आदेश प्राप्त झाल्यानंतर बदली झालेल्या अधिकार्यांना तात्काळ कार्यमुक्त करावे)

• Officers must be relieved from their current postings with full compliance of handover procedures (त्यांच्या सध्याच्या पदार्थीन कार्यमुक्त होऊन नूजू होण्यासाठी आल्यानंतर)

• Officers must be posted to their new positions without delay (त्यांना विना विलंब नूजू करून घ्यावे)

B) Mandatory Accountability:

• Penalty for Delay in Relieving: If any officer is not relieved by competent authority, the responsible officer shall be held accountable for:

  • Payment of compulsory waiting period without work assignment (काम न देता सक्तीचा प्रतिक्षाकाळ ठरविून वेतन)
  • Payment of all applicable allowances and allowances (भत्ते देण्याचा प्रसंग)

• Reporting Requirement: Concerned officers must immediately report to the Government:

  • Date of release from current posting
  • Date of joining at the new posting location (सांबांत्रित अधिकार्यांना नवीन नियुक्तीच्या जागी हजर होण्यासाठी कोर्त्या दिनांकास कार्यमुक्त के ले आणि ते नवीन नियुक्तीच्या जागी कोर्त्या दिनांकास हजर झाले याबाबत शासनास विरीत कळवावे)

Clause 4 – Prohibition on Influencing Transfer Orders:

• Prohibited Conduct: No officer may attempt to directly or indirectly exert pressure to change or modify any transfer order (बदलीच्या आदेशात बदल करून घेण्यासाठी कोर्त्याही अधिकार्यासे प्रत्यक्ष वा अप्रत्यक्षपर्े दबाव आणण्याचा प्रयत्न केल्यास)

• Consequence of Violation:

  • Constitutes violation of Rule 23 of the Maharashtra Civil Service (Conduct) Rules, 1979 (महाराष्ट्र नागरी सेवा (वर्तनूक) नियम, 1979 मधील नियम 23 चे उल्लंघन)
  • Will be treated as misconduct (ती गैरवर्तनूक समजून)
  • Disciplinary action shall be initiated against the offending officer (सांबांत्रित अधिकार्यांविरूद्ध शिस्तभंगविषयक कारवाई करण्यात येईल)

A) Legal Framework:

• This is a mandatory personnel transfer order issued under statutory authority, not a discretionary transfer

B) Critical Compliance Conditions:

1. Immediate Implementation: The order takes effect from the date of issuance (19 May 2018) — no grace period or transition period is permitted

2. Strict Handover Protocol:

NOT APPLICABLE – This is a personnel transfer order. It does not directly affect liquor license categories (FL-I, FL-II, FL-III, FL-IV, CL-I, CL-II, CL-III, Toddy, Neera, etc.). However, these transferred officers will exercise regulatory authority over all license categories in their new jurisdictions.
