C. IMMEDIATE IMPLEMENTATION — MANDATORY PROCEDURES

Clause 3 — Duties of Transferred Officers and Releasing Authorities:

1. Immediate Assumption of Duty: Officers transferred must immediately accept and assume charge of their new postings upon receipt of this transfer order.

2. Release from Current Posting: The Commissioner of State Excise must:

   a) Immediate Release: Release transferred officers from their current postings immediately upon receipt of the transfer order.

   b) Joining Procedure: When officers report for release from current posting, the Commissioner must:

   • Process their final clearance/release immediately
   • Issue transfer receipt/joining instructions without delay
   • Ensure no gaps in duty chain

   c) Assumption of New Duty: Officers must assume charge at new posting without any delay (विनाविलंब).

3. Prohibited Practice — Forced Leave/Compulsory Wait Period:

   • If any officer is kept on forced/compulsory leave (सक्तीचा प्रतिक्षाकाळ) without assigned work, such officer will be held personally liable.
   • In such cases, the releasing authority will be held accountable for unauthorized suspension of duties.

4. Documentation/Reporting Requirements:

   Officers' releasing authority must immediately report to the State Government:

   • Date on which officer was released from current posting
   • Date on which officer assumed charge at new posting
   • Status of transfer completion (transfer receipt/joining certificate)

D. PROHIBITION OF PRESSURE/INFLUENCE

Clause 4 — Disciplinary Action for Improper Conduct:

• Prohibition: No officer shall attempt—directly or indirectly—to exert pressure, influence, or lobby for changes to this transfer order.

• Violation Clause: Any such attempt constitutes:

  • Violation of Rule 23 of the Maharashtra Civil Service (Conduct) Rules, 1979 (महाराष्ट्र नागरी सेवा (वर्तनूक) नियम, 1979 — नियम 23).
  • An act of misconduct (गैरवर्तनूक).

• Consequences: Disciplinary proceedings (शिस्तभंगविषयक कारवाई) will be initiated against the officer.

Any releasing authority that places an officer on forced/compulsory leave without assigned work will be held personally responsible and may face administrative action.

3. Prohibition of Influence / Pressure Tactics

• No officer may attempt to modify, defer, or challenge this order through direct or indirect pressure.
• Such conduct violates Maharashtra Civil Service (Conduct) Rules, 1979, Rule 23.
• Penalty: Disciplinary action up to and including removal from service (शिस्तभंगविषयक कारवाई).

4. Mandatory Compliance Timeline

• By releasing authority: Officers must be released immediately upon receipt of order.
• By transferred officers: Officers must join new posting without delay.
• By receiving authority: Officers must be formally inducted into new posting without delay.

5. Reporting to State Government

Releasing/receiving authorities must provide the State Government with:

• Exact date of release from current posting
• Exact date of joining new posting
• Any obstacles or delays with explanation

6. Legal Basis for Non-Compliance Action

Non-compliance with this order may be treated as:

• Violation of duty under the Maharashtra Government Employees' Transfer Regulation Act, 2005
