3. NATURE OF PROMOTION

• The promotion is TEMPORARY (तात्पुरत्या स्वरूपात) only.
• Promotion is conditional on:
  • Finalization of seniority list of Inspectors, State Excise as of 01.01.2012
  • Compliance with service entry rules and examination rules for Sub-Inspector, State Excise rank
  • Compliance with all other conditions and rules stipulated in current Government Resolutions
  • Approval of Maharashtra Public Service Commission (MPSC)

4. PENDING COURT PROCEEDINGS

• Promotion is subject to the final judgment in High Court Writ Petition No. 8452/2004 and Transfer Applications (T.A.) 1/2014 and 2/2014 relating to reservation matters.
• In case the court declares the promotion illegal or violates reservation provisions, the promotion order may be revoked.

5. IMMEDIATE IMPLEMENTATION DIRECTIVES

Upon receipt of the promotion order, the following actions must be taken immediately:

6. CONSEQUENCES OF NON-JOINING

• If a promoted officer fails to join the new posting within ONE MONTH (मोहिन्यांचे आत) from the date of this order (01.07.2016), it will be presumed that the officer is not willing to accept the promotion (इच्छू क नसल्याचे ग्राह्य).
• The promotion order will be CANCELLED (आदेश रद्द) in such cases.

7. PREVENTION OF PRESSURE AND INTERFERENCE

• No officer shall, directly or indirectly, exert pressure to change the posting location (पदस्थापिेच्या ठिकाणात बदल करून घेणे).
• Violation constitutes Misconduct under Rule 23 of the Maharashtra Civil Service (Conduct) Rules, 1979 (महाराष्ट्र नागरी सेवा (वर्तणूक) नियम, 1979 — नियम 23).
• Penalty for violation: Disciplinary action will be initiated against the officer concerned.

8. REPORTING REQUIREMENT

The Commissioner of State Excise must immediately inform the Government:

• Date on which the promoted officer was relieved from current post
• Date on which the promoted officer joined the new posting

IMPORTANT NOTES / CONDITIONS / PENALTIES

Conditions Precedent:

2. MPSC approval — Promotion is conditional on approval from Maharashtra Public Service Commission.
