LEGAL AUTHORITY & REGULATORY COMPLIANCE
1. Regulatory Framework:

MANDATORY PROCEDURES FOR IMMEDIATE IMPLEMENTATION
A. Relieving Procedure (कार्यमुक्त करणे):
- Upon receipt of this transfer order, the Commissioner of State Excise (आयुक्त, राज्य उत्पादि शुल्क) shall immediately relieve all transferred officers from their current positions
- Transferred officers shall proceed to their original posts to formally vacate positions
- Upon arrival at original post, officers must be formally relieved and cleared
- Strict Compliance Required: Officers NOT relieved on time will trigger mandatory documentation of delay and financial implications
B. Joining Procedure (नवीन नियुक्तीने हजर होणे):
- Officers must report to new postings without delay (विनाविलंब)
- Officers must join new postings upon relief from original positions
- Failure to join within prescribed timeline constitutes non-compliance
C. Mandatory Reporting to Government:
The Commissioner of State Excise must immediately submit to Government of Maharashtra:
- Date of relieving from current position for each officer
- Date of joining at new posting for each officer
- This report must be filed swiftly (त्वरीत कळवावे)
COMPLIANCE STANDARDS & PENALTIES
1. Duration of Posting (महसूली विभाग वाटप कालावधी):
- Officers must complete prescribed tenure period in assigned revenue department postings as per 2015 Rules provisions
2. Unauthorized Absence & Financial Liability:
- If an officer is NOT relieved and/or NOT joined within stipulated timeframe, the following consequences shall apply:
- Officer cannot discharge full duties
- Forced leave period (सक्तीचा प्रतीक्षाकाळ) shall be declared
- Officer becomes liable to:
- Forfeiture of salary and allowances during forced leave period
- Personal financial liability for delay-related costs
- Responsible officers (प्रशासकीय अधिकारी) shall be held personally accountable
3. Misconduct for Obstruction (Rule 23, Maharashtra Civil Service Conduct Rules, 1979):
Any officer who directly or indirectly attempts to influence, pressure, or obstruct implementation of this transfer order:
- Violation: Rule 23 of Maharashtra Civil Service (Conduct) Rules, 1979 (महाराष्ट्र नागरी सेवा (वर्तणूक) नियम, 1979)
- Classification: Misconduct (गैरवर्तणूक)
- Action: Disciplinary proceedings against the offending officer (शिस्तभंगविषयक कारवाई)
- Applicability: "Direct or indirect pressure" includes persuasion, threats, or interference from any source

IMPORTANT NOTES & CONDITIONS
1. Territorial Jurisdiction Changes:
Officers assume complete inspection and enforcement authority in new postings for all excise licenses issued in new divisional/city jurisdictions. Previous posting officers relinquish all authority upon relief.
2. Revenue Department Posting Mandatory Tenure:
Each transferred officer must complete the full prescribed tenure in the assigned revenue department division/circle before any further transfer. Early release requires Government authorization.
3. Immediate Operational Impact:

- Inspection of retail and wholesale alcohol licenses
- Collection of excise revenues
- Compliance monitoring of license conditions
- Investigation of excise violations
- Control of illicit liquor manufacture and trade

Outgoing officers must hand over all records, registers, and files within 24 hours of relief
4. No Challenge / No Suspension Clause:
This order is final and non-negotiable. No officer may:
- Request deferment of transfer
- Appeal the posting decision
- Request posting to alternative location
- Seek modification of joining date
Any such request shall be rejected outright and noted as disciplinary misconduct.
