This Government Resolution permits the unrestricted export of molasses (मळी) produced within Maharashtra state to other states and foreign countries. Previously, District Collectors were given a temporary 3-month pilot authority (from 15 May 2015) to permit molasses exports without obtaining prior approval from the Commissioner of State Excise. This GR makes that authority permanent and establishes detailed procedural guidelines for both inter-state and international molasses exports. The resolution devolves approval authority entirely to District Collectors, who must ensure compliance with statutory regulations and specific conditions regarding analysis, taxation, transport, and documentation.
The District Collector (जिल्हाधिकारी) must ensure the following conditions are satisfied before granting permission:
No-Objection Certificate from Excise Department: Obtain a no-objection or non-objection certificate (हरकत प्रमाणपत्र) from the Excise Department of the destination state.
Importer's License in Destination State: Obtain a copy of the valid statutory license held by the recipient in the destination state permitting possession/use of molasses.
Consent from Sugar Factory: Obtain a written consent letter or sales order (संमतीपत्र/सेल ऑर्डर) from the originating sugar factory in Maharashtra from which molasses will be exported.
Payment of Prescribed Fee: Collection of prescribed administrative fees is mandatory.
Transport Under Supervision: Molasses shall be transported under supervision from the sugar factory to the border checkpoint (सीमा तपासणी नाक्या) of the neighboring state.
Analysis Report for Each Consignment: Obtain and file an analysis report (विश्लेषण अहवाल) from the sugar factory for each consignment of molasses exported. Issue a TRS (Tax Removal Slip/निर्यात पास) based on the analysis report for each consignment.
EVC (Export Verification Certificate) Within 30 Days: The EVC from the destination state must be received within 30 days of export. No fresh M-5 permit for subsequent export shall be approved until the EVC from the previous export is received.
Re-weighment at Maharashtra Border Checkpoint: At the Maharashtra state border checkpoint (महाराष्ट्र सीमेच्या तपासणी नाक्या), the molasses tanker must be re-weighed to confirm that the quantity exported matches the TRS issued. Inspectors (निरीक्षकांनी) at the destination border checkpoint shall issue an export pass (निर्यात पासापोर्ट) confirming the quantities. Exception: This condition does not apply if molasses is exported by railway.
Alcohol Content Limit: The alcohol content (मद्याकाचा उतारा) extracted from exported molasses shall not be less than 250 BL (बॉटलिंग लिटर), equivalent to 415 Proof Liters, as determined by Commissioner of State Excise Circular No. MALLI-112001/1310/5-A dated 12 September 2002.
Unit Operational Status Certificate: Obtain a certificate confirming whether the exporting unit is operational or closed (दियंतरणार्थ घटक कार्यान्वित आहे किंवा बंद आहे याचे प्रमाणपत्र).
Stock Receipt Certificate from Destination State: After approval is granted, obtain a certificate from the Commissioner/Superintendent of State Excise of the destination state confirming receipt of stock (साठा मिळालाबाबतचे रक नंबर/चालकाच्या नावासहीत प्रमाणपत्र).
No Export to Blacklisted Units: Do not grant export permission to units that have been blacklisted by other states.
Before granting permission for international export, District Collector must obtain:
Recognized Export House Certificate: Certificate confirming that the exporting unit is a recognized export house (मान्यताप्राप्त निर्यात घटक असल्याबाबतचे प्रमाणपत्र) — i.e., a Registered Export House.
Import Orders and Contracts: Import orders (ऑर्डर्स) and contracts (करारपत्र) with foreign importers.
Bank Credit Authorization: Certificate from a nationalized or other authorized bank confirming credit facility or equivalent authorization (राष्ट्रीयकृत किंवा इतर बँकामार्फत निर्यात करण्याबाबतचे मान्यता दिलेले क्रेडिट किंवा तत्सम पत्र) for conducting exports.
Port/Harbor Export Facility and CRZ Clearance: Updated export facility details and current Coastal Regulation Zone (CRZ) clearance (अद्ययाित CRZ परवानगी) from the port/harbor through which molasses will be exported.
Export History: Details of whether the unit is a first-time exporter or has exported previously, including particulars of previous exports (घटक प्रथम निर्यात करीत आहे किंवा मागील काळात निर्यात केली असल्यास त्या निर्यातीबाबतचा तपशील).
GMP (Good Manufacturing Practice) Certificate: GMP certificate to demonstrate the quality/standard of the product being exported (जेणेकरुन निर्यातीबाबतचा वजा वर्णदिला जातो).
Analysis Report for Each Shipment: Obtain analysis report (विश्लेषण अहवाल) from the sugar factory for each shipment of molasses being exported. Issue TRS (Tax Removal Slip) for each shipment based on the analysis report.
Administrative Fee Payment: Collection of prescribed administrative fees in accordance with regulations is mandatory.
Transport Under Supervision: Transport from sugar factory to port/harbor for export must be conducted under supervision (पर्रक्षणाखाली करणे बंधिकारक राहील) as per Government Order No. MLS-1995/5/EXC-2 dated 6 December 1996.
Port-Based Export Only: International exports must be conducted exclusively from ports/harbors located in Maharashtra state. No other mode of international export is permitted (कोणत्याही परिस्थितीत परदेशातील निर्यात ही राज्यातील बंदरातुनच करावी लागेल).
After granting export permission under the above norms, the concerned Superintendent of State Excise (अधीक्षक, राज्य उत्पादन शुल्क) must submit a detailed monthly report by the 10th of each month to the Commissioner of State Excise containing:
District Collector Authority: District Collectors are empowered to grant export permission for both inter-state and international exports of Maharashtra-produced molasses.
No Commissioner Approval Required: Proposals for inter-state or international molasses export do not require prior approval from the Commissioner of State Excise or the Government (आयुक्त, राज्य उत्पादन शुल्क ि शासनास सारीर करण्याची आवश्यकता नाही).
Existing Regulations Apply: District Collectors must comply with all existing rules, regulations, and the specific conditions listed above.
Legislative Basis: This resolution follows a declaration made in the Budget Session of the Legislative Assembly in 2015, which directed that Maharashtra-produced molasses be exempted from control in inter-state/international trade.
Pilot Period: District Collectors were initially granted temporary authority for 3 months (from 15 May 2015) to permit exports on a pilot/experimental basis (प्रायोगिक तत्वावर).
Review and Permanent Policy: After the pilot period ended, a policy review was conducted, and this GR makes the authority permanent.
Not applicable — This GR does not relate to retail or wholesale liquor licenses (FL-I, FL-II, FL-III, FL-IV, CL-I, CL-II, CL-III, Toddy, Neera licenses). It concerns industrial export of molasses, a byproduct of sugar manufacture, not finished alcoholic beverages.
Railway Export Exception: If molasses is exported by railway, the re-weighment condition at Maharashtra border checkpoint (Condition A.8) does not apply.
Blacklist Check Mandatory: Units blacklisted by other states cannot be granted inter-state export permission.
EVC Dependency: No subsequent export permit shall be issued until the EVC (Export Verification Certificate) from the previous export is received within 30 days.
Port-Only International Export: International exports must be routed exclusively through Maharashtra state ports. No alternative export routes are permitted.
Sugar Factory Consent: Molasses export permission is contingent on obtaining explicit written consent from the originating sugar factory.
Alcohol Content Compliance: Exported molasses must meet the minimum alcohol content standard (250 BL / 415 Proof Liters) as prescribed by the Commissioner's 2002 circular.
