B. COMPLIANCE DIRECTIVES

Clause 2 — Immediate Implementation:

  • This order comes into immediate effect.
  • All transferred officers must immediately handover their current charge to other officers and join their new posted positions without delay.
  • Officers must comply with Election Commission guidelines dated 31 July 2024.
  • Compliance report must be submitted by 20 August 2024 to the Commissioner, State Excise Department.
  • The Commissioner must ensure all officers report to their new positions immediately and submit the compliance report urgently.

    • C. PENALTIES FOR NON-COMPLIANCE

    Clause 3 — Disciplinary Action:

    • If any officer fails to join the new posting within the prescribed timeframe, OR
    • If any officer attempts to reverse or pressure the reversal of the transfer, such conduct shall be treated as misconduct under Rule 23 of the Maharashtra Civil Service (Conduct) Rules, 1979 (महाराष्ट्र नागरी सेवा (वर्तणूक) नियम, १९७९).
    • Disciplinary proceedings will be initiated against the offending officer.
    • Additionally, such conduct shall invite disciplinary action under the provisions of the Public Representatives Act, 1950 (लोकप्रतिनिधित्व अधिनियम, १९५०).

      • D. LEAVE RESTRICTIONS

      Clause 4 — Leave Restrictions During Transfer:

      • No leave shall be granted to the transferred officers without prior permission from the Government (शासनाच्या पूर्वपरवानगीशिवाय कोणत्याही कारणास्तव रजा मंजूर करू नये).
      • In accordance with Rule-30(C) of the Maharashtra Civil Service (Leave) Rules, 1981, the original office shall not accept any leave applications from transferred officers.
      • Any leave application received must be returned to the officer at their registered address by registered post without acceptance.
