The Maharashtra Prohibition Act, 1949.
Introduction
1. Overview and Constitutional Foundation
The Maharashtra Prohibition Act, 1949 (formerly the Bombay Prohibition Act, 1949) is the principal legislation regulating the manufacture, possession, transport, sale, purchase and consumption of intoxicating liquors within the State of Maharashtra. The Act was enacted to amend and consolidate
laws relating to prohibition and excise administration. It received the assent of the Governor
General on 15 May 1949 and was first published in the Bombay Government Gazette on 20 May
1949.
The legislative competence for the Act flows from Article 246(3) of the Constitution of India read
with Entry 8 of List II (State List) of the Seventh Schedule. The policy foundation is rooted in Article
47 of the Constitution, which directs the State to endeavour towards prohibition of intoxicating
drinks injurious to health.
2. Core Regulatory Framework
• General prohibition of activities relating to intoxicating liquor unless licensed or permitted.
• Licensing system for manufacture, wholesale and retail trade.
• Permit system for regulated individual consumption.
• Control over storage, transport, import and export of liquor.
• Regulation of industrial alcohol and denatured spirit.
• Excise duties and countervailing duties on excisable articles.
• Search, seizure, arrest and confiscation powers vested in authorities.
3. Prohibitions and Offences
The Act prohibits the manufacture, sale, possession, transport, import, export and consumption of
intoxicants without proper authorization. Sale to minors, illegal tapping of toddy-producing trees,
misuse of denatured spirit, and illicit distillation are specifically penalized. Penalties include
imprisonment, fines, enhanced punishment for repeat offenders, and confiscation of goods and
conveyances.
4. Administrative and Enforcement Mechanisms
The Act empowers Prohibition Officers, Excise Officers and Police Officers to investigate offences,
conduct searches, seize contraband and arrest offenders where authorized. Appeals and revisions
are provided before higher authorities including the Collector, Commissioner and State
Government. The Act also enables the establishment of Gram Rakshak Dal for assisting
enforcement.
5. Delegated Legislative Powers
• Section 139 – Power of the State Government to issue orders for carrying out the purposes of
the Act.
• Section 143 – Power of the State Government to frame rules regarding licensing, permits, fees
and regulatory procedures.
• Section 144 – Power of the Commissioner of State Excise to issue regulations and
administrative directions, consistent with the Act and rules.
6. Interaction with NDPS Act
Certain intoxicating drugs such as cannabis (ganja and charas), opium and other narcotic
substances originally referenced in the Act are now primarily governed by the Narcotic Drugs and
Psychotropic Substances Act, 1985 (NDPS Act), enacted under Union List powers. The
Maharashtra Prohibition Act presently focuses predominantly on intoxicating liquors and
alcohol-based substances.
7. Historical Evolution and Amendments
The Act evolved from the Bombay Abkari Act, 1878 and the post-independence movement for
prohibition. Following the reorganization of states, it was adapted to the State of Maharashtra and
officially renamed as the Maharashtra Prohibition Act in 2012. Various amendments over the years
strengthened enforcement, introduced regulatory controls over denatured preparations, enhanced
penalties, and empowered local governance bodies in specific areas.
8. Schedules
The Act contains schedules specifying repealed enactments, amendments to related laws, territorial
applications, and savings provisions consequential to extensions of the Act.
Conclusion
The Maharashtra Prohibition Act, 1949 represents a comprehensive regulatory framework designed
to promote public health, regulate intoxicating liquors, ensure revenue control and empower
authorities for effective enforcement. Through continuous amendments and administrative
refinement, the Act remains the foundational statute governing alcohol regulation in the State of
Maharashtra.
After adopting the Government of India Act, 1935, the responsibility for regulating intoxicants and alcohol was transferred to the state governments. The states were given the power to regulate the production, distribution, and sale of alcohol. The provincial Government formed in the state of Bombay adopted a stricter policy of regulation and enacted the Bombay Prohibition Act in 1949, (repelling the British era The Bombay Abkari Act,1876 ) which prohibited the manufacture, sale, and consumption of alcohol in the state. The act also established the Director of Prohibition and Excise as head of the Prohibition and Excise Department with the responsibility of administration and carrying out the provisions of the Act, including the regulation of the production, distribution, consumption and sale of alcohol in the state. This act provides for licensing, regulating & controlling the alcoholic liquors and raw materials used for manufacturing of the liquor.
Government have power under section 139 & 143 to makes the orders & rules respectively. Commissioner State excise has power to make regulation under section 144. Using these powers there are around 49 rules and 5 regulations and around 139 orders issued by government until end of 2011.
