Whereas the Government of Maharashtra considers to make the Maharashtra Gram Rakshak Dal Rules, should be brought into force at once, and therefore the rules should be made without previous publication as provided by the proviso to sub-section (3) of section 143 ofthe Maharashtra Prohibition Act (XXV of 1949); Now, therefore, in exercise of the powers conferred by clauses (x), (y) and (z) of sub-section (2) read with the proviso to sub-section (3) of section 143 of the Bombay Prohibition Act, 1949 and ofall other powers enabling it in that behalf the Government of Maharashtra hereby makes the following rules, namely
Definitions.-
In these rules, unless the context otherwise requires,(a) "Act" means the Maharashtra Prohibition Act (XXV of 1949); (b) "application"means a representation submitted by women voters of the Gram Sabha to Sub-Divisional Magistrate; (c) "Form" means the Forms appended to these rules ; (d) "Gram Sabha" means the Gram Sabha as defined in clause (9) of Section 3 of the Maharashtra Village Panchayats Act, 1958 ; (e) "Gramsevak" means the secretary to the Panchayat as defined in sub-section (20) of section 3 of the Maharashtra Village Panchayat Act, 1958; (f) "Sub-Divisional Magistrate", "Tahsildar" and "Talathi" means the officers mentioned in the Maharashtra Land Revenue Code, 1966. (2) Words and expressions used in these rules but not defined in these rules shall have meanings respectively assigned to them in the Act. (1) 3.
Procedureforfiling representation by Gram Panchayat and Women Vbters.- (/) If Village Panchayat decides to establish a Gram Rakshak Dal in a village, as provided in sub-section (l)of section 134A, shall apply in Form-A appended to the rules, to the Sub-Divisional Magistrte along with a copy of the Resolution passed by the Panchayat, to convey a special meeting of Gram Sabha, fbr establishment of the Gram Rakshak Dal in the Village. (2) If the Women of the Village decides to establish a Gram Raskshak Dal in a village provided in sub-section (l)of section 134A, shall apply in Form-B appended to the rules, to Sub-Divisional Magistrate to convey a special meeting of the Gram Sabha, fbr establishment ofthe Gram Rakshak Dal in the Village. (3) The Gramsevak shall forward the application received, to the Sub-Divisional Magistrate.
Sub-Divisional Magistrate to convene special meeting of the Gram Sabha when application received under rule 3(1).~ 4. (1) When an application under sub-rule (J) ofrule 3 is received, fbr establishment of the Gram Rakshak Dal in a village, the Sub-Divisional Magistrate shall direct theTahsildar to convene a special meeting of the Gram Sabha of that village within a month. (2) The Tahsildar shall decide the date and time of the special Gram Sabha in consultation with the Gram Panchayat.
