In exercise of the powers conferred by clauses (d), (e), (f), (g), (h), (i), (k), (l) 1* (13) and (u) of sub-section (2) of section 143 of the Bombay Prohibition Act, 1949 (Bom. XXV of 1949), and of all other powers enabling it in this behalf and in supersession of all previous rules in this behalf, the Government of Maharashtra hereby makes the following Rules, the same having been previously published as required by sub-section (3) of the said section 143 :
मुंबई दारूबंदी अधिनियम, १९४९ (मुंबई अधिनियम XXV सन १९४९) च्या कलम १४३ च्या उपकलम (२) च्या खंड (ड), (इ), (फ), (ग), (ह), (आय), (क), (ल), १*(१३) आणि (य) द्वारे प्रदान केलेल्या अधिकारांचा आणि त्या संबंधात समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून आणि या संबंधातील सर्व पूर्वीच्या नियमांचे अधिक्रमण करून, महाराष्ट्र शासन याद्वारे पुढील नियम करीत आहे, ते सदर कलम १४३ च्या उपकलम (३) अन्वये आवश्यकतेनुसार पूर्वप्रसिद्ध करण्यात आलेले आहेत:
Short title and extent शीर्षक आणि व्याप्ती
These rules may be called the Maharashtra Toddy Shops (Licensing) and Toddy Trees (Tapping) Rules, 1968.
These rules extend to the whole of the State of Maharashtra except the Tribal areas.]
Definitions व्याख्या
In these Rules, unless there is anything repugnant in the subject or context,—
(a) “Act” means the Bombay Prohibition Act, 1949;
2“(a1) “Auction-cum-Tender Order” means the Maharashtra Toddy Shops (Grant of Licenses) by Auction-cum-Tender Order, 2001;”;
2,8“(a2) “bid” means an offer of bid money by bidder in an auction and includes a tender;”.
(b) “duty” means duty levied under section 109 of the Act;
(c) “Form” means a form appended to these Rules;
(d) “licence” means a licence granted under these Rules;
(e) “licensed shop” means the shop in which a licensee has been licensed to sell toddy under his licence;
(f) “licensee” means the holder of a licence;

(h) “superintendent” means the Superintendent of Prohibition and Excise or the District Inspector of Prohibition and Excise, as the case may be;
(i) 4“Toddy” means “fermented juice drawn from a coconut, brab, date or any kind of palm tree” containing not more than five per cent alcohol by volume but does not include sweet toddy, nira or neera;
5(j) “Tribal area” means the area specified in the Schedule to these rules.
विषयात किंवा संदर्भात एतद्विरुद्ध काही नसल्यास या नियमांमध्ये,— (अ) "अधिनियम" म्हणजे मुंबई दारूबंदी अधिनियम, १९४९; (अ१) "लिलाव-तद्वत-निविदा आदेश" म्हणजे महाराष्ट्र ताडी दुकाने (लिलाव-तद्वत-निविदाद्वारे परवान्यांचे अनुदान) आदेश, २००१; (अ२) "बोली" म्हणजे लिलावात बोलीदाराने बोली रकमेची ऑफर आणि त्यात निविदा समाविष्ट आहे; (ब) "शुल्क" म्हणजे अधिनियमाच्या कलम १०९ अन्वये आकारण्यात येणारे शुल्क; (क) "नमुना" म्हणजे या नियमांना जोडलेला नमुना; (ड) "परवाना" म्हणजे या नियमांखाली मंजूर केलेला परवाना; (इ) "परवानाप्राप्त दुकान" म्हणजे ज्या दुकानात परवानाधारकास त्याच्या परवान्याखाली ताडी विक्री करण्यास परवाना देण्यात आला आहे ते दुकान; (फ) "परवानाधारक" म्हणजे परवान्याचा धारक; (ह) "अधीक्षक" म्हणजे दारूबंदी आणि उत्पादन शुल्क अधीक्षक किंवा दारूबंदी आणि उत्पादन शुल्क जिल्हा निरीक्षक, यथास्थिति; (आय) "ताडी" म्हणजे नारळ, ब्राब, खजूर किंवा कोणत्याही प्रकारच्या ताड झाडातून काढलेला आंबवलेला रस ज्यात आकारमानानुसार पाच टक्क्यांपेक्षा अधिक मद्यार्क नाही परंतु त्यात गोड ताडी, नीरा किंवा नीर समाविष्ट नाही; (ज) "आदिवासी क्षेत्र" म्हणजे या नियमांना जोडलेल्या अनुसूचीत विनिर्दिष्ट केलेले क्षेत्र.
Prohibition of sale of toddy except under a licence विनापरवाना ताडी विक्रीस मनाई
No person shall sell toddy except under a licence.
कोणतीही व्यक्ती परवान्यावाचून ताडी विकणार नाही.
Grant of licence परवाना देणे
Every person 6[whose bid or tender has been accepted under the 8Auction-cum-tender order may, subject to the provisions of sub-rule (2) be granted a licence in Form TD-1 on his executing a counter-part agreement in Form TD-2 within 4fifteen days of auction 2or of the acceptance of the tender.
No licence shall be granted in respect of any shop.—
(a) which is less than nine square metres in area and which, in the opinion of the Collector, will not be adequate for consumption of toddy and where such consumption will be in public view;
(b) which, if situated in the areas within the jurisdiction of any Municipal Corporation or ‘A’ Class or ‘B’ Class Municipal Council, is within a distance of fifty metres and if situated else where, one hundred metres, from any educational or religious institution or any Statue of National Personality or
(c) which is situated within a distance of one hundred metres from any bus stand, station or depot of the Maharashtra State Road Transport Corporation; or
(d) which is not duly approved by the Collector of the Officer authorised by him in this behalf and which is not, for reasons to be recorded in writing, certified by him to be otherwise suitable also for locating the shop before the grant of the licence :
Provided that nothing in this sub-rule shall apply in respect of an existing shop for which the licensee holds a licence in Form T.D.I. immediately before the coming into force of the Maharashtra Toddy Shops (Licensing) and Toddy Trees (Tapping) (Amendment) Rules, 1981 and the Maharashtra Toddy Shops (Licensing) and Toddy Trees (Tapping) (Amendment) Rules, 2015.
Explanation.—For the purpose of this sub-rule,—
(i) “educational institution” menas any pre-primary, primary or secondary school managed or recognised by any local authority or the State Government or the Central Government or any college affiliated to any University established by law, but does not include any private coaching institution;
(ii) “religious institution” means an institution for the promotion of any religion and includes a temple, math, mosque, church, synagogue, aglary, or other place or public religious workship which is managed or owned by a public trust registered under the Bombay Public Trusts Act, 1950 (Bom. XXIX of 1950) and includes such other religious
institutions as the State Government may by order specify in this behalf;
(iii) the distance referred to in clause (b) or (c) of this sub-rule shall be measured from the mid-point of the entrance of the shop along the nearest path by which a pedestrian ordinarily reaches,—
(a) the mid-point of the nearest gate of the institution, if there is a compound wall, and if there is no compound wall, the mid-point of the entrance of the institution, or
(b) the mid-point of the nearest gate of any bus stand, station or depot of the Maharashtra State Road Transport Corporation, if there is a compound wall and if there is no compound wall, the nearest point of the boundary of such bus stand, station or depot.]
(c) The mid-point of the nearest gate of the Statue, if there is a compound wall, and if there is no compound wall, the nearest point of foundation of such a Statue.
(iv) Statue of National Personality means any Statue of the National Personality recognized by Government and specified in the Schedule-I appended to these rules.
No licence shall be granted for more than one shop.]
Any shop in respect of which a licence in Form T.D.I. has been granted shall not be deemed to be situated within the prohibition distance referred to in clause (b) or (c) of sub-rule (2) if at any time after such licence is granted,—
(a) any institution or any Statue of National Personality specified in Schedule-I referred to in clause (b) of sub-rule (2) comes into existence within a distance of fifty metres or as the case may be, one hundred metres from that shop, or
(b) if any bus stand, station or depot referred to in clause (c) of sub-rule (2) comes into existence within a distance of one hundred metres from that shop.]

No license under this rule shall be granted or renewed in respect of any shop which shall bear a name of the national personalities or any subsequent change in the name of national personalities and shall not bear the name of any of the Forts declared by the Central Government as protected monuments under the Ancient Monuments Preservation Act, 1904 (7 of 1904) and by the State Government as protected monuments under the Maharashtra Ancient Monuments and Archaeological Sites and Remains Act, 1960 (Mah. XII of 1961), as specified in the Schedule II appended to these rules.”

Prohibition to shift licensed shop to any other place परवानाप्राप्त दुकान इतर कोणत्याही ठिकाणी स्थानांतरण करण्यास मनाई
The licensed shop shall not be shifted to any other site without the prior approval of the Collector :
Provided that the Collector 1may, if the licensee himself desires so to do (and not at the direction of the Collector), allow the licensee to shift his licensed shop to some other site in the same locality on payment of a fee of rupees twenty-five, not with standing anything contained in any other rules made under the Act.
जिल्हाधिकाऱ्यांच्या पूर्वमान्यतेशिवाय परवानाप्राप्त दुकान इतर कोणत्याही ठिकाणी स्थानांतरित केले जाणार नाही : परंतु जिल्हाधिकारी, परवानाधारकाची स्वतः इच्छा असल्यास (आणि जिल्हाधिकाऱ्यांच्या निर्देशानुसार नव्हे), अधिनियमान्वये केलेल्या इतर कोणत्याही नियमांमध्ये काहीही असले तरी, पंचवीस रुपये शुल्क भरून परवानाधारकास त्याचे परवानाप्राप्त दुकान त्याच परिसरात इतर ठिकाणी स्थानांतरित करण्यास परवानगी देऊ शकतात.
Closure of shops दुकान बंद असण्याचे दिवस
Every licensed shop shall remain closed on 2nd October every year and 11[ “fourty eight hours ending with the hours fixed for the conclusion of the poll in relation to any general election or by-election to the House of people or the Maharashtra Legislative Assembly is taken in the constituency in which such premises are located and on the counting day or days”] and on such special occasions and in such areas, as the State Government may, after giving a notice of not less than seven days in the Official Gazette and in any local newspaper circulating in such area, specify in this behalf and in all such cases, the licensee shall not be entitled to any compensation ;
Every licensed shop shall remain closed on the day or days on which poll in relation to any general election or by-election to any local authority in the State is taken in the constituency in which such premises are located and a day immediately before such day of poll and on the counting day.” ]
Power of Collector to close down licensed shops, etc. in public interests सार्वजनिक हितासाठी परवानाप्राप्त दुकाने इत्यादी बंद करण्याचा जिल्हाधिकाऱ्यांचा अधिकार
If in the opinion of the Collector, it is necessary in the public interest to do so, he may by order require the licensees.—
(a) to close down, generally or in any local area, licensed shops for such period as may be specified in the order;
(b) to close down licensed shops on such day or days as may be notified to be pay day or pay days in the order and in such local areas as may be specified in the order;
(c) to curtail the hours of sale.
Any licensee who is affected by an order under sub-rule (1) shall not be entitled to any compensation]
Transfer of licence परवान्याचे हस्तांतरण
It is entirely within the diseretion of the Collector to permit the transfer of a licence from one name to another or to admit or omit the name of any partner after the licence is granted. The licensee shall be liable to pay a fee of rupees one thousand 2[or twenty-five per cent. of the amount of the bid accepted under the 10Auction-cum-Tender order, whichever is lower,] for the transfer of a licence or for each partner whose name is so entered 2or omitted, anything contained in any other rules made under the Act, notwithstanding.
परवाना मंजूर झाल्यानंतर परवान्याचे एका नावावरून दुसऱ्या नावावर हस्तांतरण करण्यास किंवा कोणत्याही भागीदाराचे नाव समाविष्ट करण्यास किंवा वगळण्यास परवानगी देणे हे पूर्णपणे जिल्हाधिकाऱ्यांच्या विवेकाधीन आहे. अधिनियमान्वये केलेल्या इतर कोणत्याही नियमांमध्ये काहीही असले तरी, परवानाधारकास परवान्याच्या हस्तांतरणासाठी किंवा ज्याचे नाव अशा प्रकारे समाविष्ट किंवा वगळले गेले आहे अशा प्रत्येक भागीदारासाठी एक हजार रुपये किंवा लिलाव-तद्वत-निविदा आदेशानुसार स्वीकारलेल्या बोलीच्या रकमेच्या पंचवीस टक्के, यापैकी जे कमी असेल ते शुल्क भरण्यास जबाबदार असेल.
Duration of licence परवान्याचा कालावधी
The period for which a licence shall ordinarily be granted shall be from 1st September to 31st August next following, and no licence shall be granted for any period extending beyond the 31st day of August following the date of the grant of the licence.
ज्या कालावधीसाठी परवाना सामान्यतः मंजूर केला जाईल तो कालावधी १ सप्टेंबर ते त्यापुढील ३१ ऑगस्ट असेल, आणि परवाना मंजूर करण्याच्या तारखेनंतरच्या ३१ ऑगस्टच्या पुढील कोणत्याही कालावधीसाठी कोणताही परवाना मंजूर केला जाणार नाही.
Trees not be tapped unless duty is paid etc शुल्क ई. दिल्यावाचून ताडीचे झाड छेदु नये
he has paid to the State Government, the duty in respect there of at the rates directed by the State Government from time to time ;
he has obtained a permit as provided in rule 17; and
the trees are duly marked and numbered in the manner approved by the Commissioner.
Tapping of trees ताडीचे झाड छेदणे
Trees shall be tapped only by professional men experienced in tapping.
No date or wild palm (commonly known as “Khajuri” or “ Shendi” tree) shall be tapped for more than four months in a year and no such trees shall be tapped for three consecutive years after the expiry of the year in which it is tapped ;
Provided that, the Collector may allow any such tree to be tapped in every alternate year, if in his opinion, tapping is necessary for want of other trees.
No tree shall be tapped daily during the currency of the tree tapping permit.
In the case of a date tree, no initial incision shall be made at any point within two metres from the foot of the tree of forty-five centimetres from the top of any other incision.
The depth and width of the incision made on a tree shall not be more than onethird of the diametres of the tree at the point of incision and the length of the incision shall not exceed twenty centimetres.
The central spike-like cluster of any date or palm tree shall not be touched. In addition to the central spike-like cluster, not less than eight other leaves shall, except for reasons beyond the control of the licensee, be left, in on that face of the tree on which the incision is made above the top line of the incision.
The licensee shall not cut or injure or permit to be cut or injured any Government tree in respect of which a tree tapping permit is granted to him or make any incision in that tree so as to cause its death.
If as a result of any contravention of any of the foregoing sub-rules, a Government tree dies during the currency of the the tree tapping permit or within a period of six months after the expiration of such permit, the licensee shall be liable to pay to Government, such sum not exceeding ten rupees in respect of each such tree as may be determined by the Collector after giving the licensee reasonable opportunity of being heard.]
Commencement of period for drawing of toddy ताडी काढण्याकरिताच्या कालावधीची सुरुवात
The pots shall not be attached to the trees for the purpose of drawing toddy 2more than 24 hours before the actual commencement of the licence.
ताडी काढण्याच्या प्रत्यक्ष प्रारंभाच्या २४ तासांपूर्वी ताडी काढण्याच्या उद्देशाने झाडांना भांडी जोडण्यात येणार नाहीत.

Inspection of pots for collecting toddy ताडी गोळा करण्यासाठीच्या भांड्याची तपासणी
The licensee or his authorised employees shall lower down the pot attached to any tree if any Prohibition Officer not below the rank of a Sub-Inspector orders so to do for the purpose of inspection.
परवानाधारक किंवा त्याचा प्राधिकृत कर्मचारी, दारूबंदी अधिकारी, जो उप-निरीक्षक दर्जापेक्षा कमी नसेल, जर तपासणीच्या उद्देशाने असे करण्याचा आदेश देईल तर कोणत्याही झाडास जोडलेली भांडी खाली उतरवेल.
Mode of collection and transport of toddy etc ताडी गोळा करण्याची पद्धत व त्याची वाहतूक इत्यादी
The licensee or his authorised employees shall, after the pots are lowered down from the trees, immediately collect the toddy in 1the casks or vessels of such kind and capacity as may be approved by the Collector, at one place and transport it to the licensed shop, under cover of a transport pass in Form TD-3 issued by the licensee or any person duly authorized by him in this behalf. 2[Where the licensee has more than one licensed shop, he may notwithstanding anything contained in the rule 21, remove the toddy collected to a place for being bottled or stored in one container during the hours of sale laid down in rule 22 (such place being called a transit centre) and may transport it during those hours from such centre to each of his licensed shops according to its requirement under cover of a transport pass in Form TD-3A issued by the licensee or any person duly authorized by him in this behalf. The licensee shall not remove the toddy so stored or bottled to any place other than the licensed shops or the transit centre or sell toddy either in transit or elsewhere including such transit centre or give it to anybody under any pretext, except in his licensed shop.]
परवानाधारक किंवा त्याचा प्राधिकृत कर्मचारी, झाडावरून भांडी खाली उतरवल्यानंतर, तात्काळ जिल्हाधिकाऱ्यांनी मंजूर केलेल्या प्रकार आणि क्षमतेच्या पिंपात किंवा भांड्यांमध्ये एका ठिकाणी ताडी गोळा करेल आणि परवानाधारक किंवा त्याने या संबंधात यथोचितपणे प्राधिकृत केलेल्या कोणत्याही व्यक्तीने जारी केलेल्या नमुना टीडी-३ मधील वाहतूक पासाच्या संरक्षणाखाली परवानाप्राप्त दुकानात वाहतूक करेल. जेथे परवानाधारकाकडे एकापेक्षा अधिक परवानाप्राप्त दुकाने असतील, तो नियम २१ मध्ये काहीही असले तरी, नियम २२ मध्ये नमूद केलेल्या विक्रीच्या वेळेत बाटलीबंद करण्यासाठी किंवा एका पात्रात साठवण्यासाठी (अशा ठिकाणास संक्रमण केंद्र म्हणतात) गोळा केलेली ताडी एका ठिकाणी नेऊ शकतो आणि परवानाधारक किंवा त्याने या संबंधात यथोचितपणे प्राधिकृत केलेल्या कोणत्याही व्यक्तीने जारी केलेल्या नमुना टीडी-३ए मधील वाहतूक पासाच्या संरक्षणाखाली त्या वेळेत अशा केंद्रावरून त्याच्या प्रत्येक परवानाप्राप्त दुकानात त्याच्या आवश्यकतेनुसार वाहतूक करू शकतो. परवानाधारक अशा प्रकारे साठवलेली किंवा बाटलीबंद केलेली ताडी परवानाप्राप्त दुकाने किंवा संक्रमण केंद्र याव्यतिरिक्त इतर कोणत्याही ठिकाणी नेणार नाही किंवा वाहतुकीत किंवा अशा संक्रमण केंद्रासह इतरत्र ताडी विकणार नाही किंवा त्याच्या परवानाप्राप्त दुकानात वगळता कोणत्याही बहाण्याने कोणालाही देणार नाही.
Form of transport pass to be printed etc. वाहतूक पासच्या नमुन्याचे मुद्रण इत्यादी
The transport pass shall be got printed by the licensee, in duplicate having serial numbers. The passes shall be bound in books and got stamped with the official seal of the 3Superintendent in whose jurisdiction the licensed shop is located.
वाहतूक पास परवानाधारकाने अनुक्रमांक असलेल्या प्रतिलिपींसह छापून घ्यावा. पास पुस्तकांमध्ये बांधून घ्यावे आणि ज्या अधीक्षकांच्या अधिकारक्षेत्रात परवानाप्राप्त दुकान स्थित आहे त्यांच्या अधिकृत मुद्रेने मुद्रांकित करून घ्यावे.
Permit for storing toddy at transit centre संक्रमण केंद्रावर ताडी साठविण्यासाठीचा परवाना
No licensee shall store toddy at any transit centre unless he obtains a permit in Form-A.
Any licensee desiring to obtain a permit in Form-A may apply to the Collector for the permit. Every such application shall contain the following particulars, namely ;
(i) Name of the applicant.
(ii) Numbers and dates of licences obtained by the applicant.
(iii) Place, that is, the transit centre, where the toddy is to be stored.
(iv) Shops to which toddy will be supplied from the transit centre.
On receipt of an application under sub-rule (2), the Collector shall make inquiries for verification of the particulars given in the application, the suitability of the location of the transit centre and such other inquiries as he deems necessary. If he is satisfied that there is no objection to grant the permit applied for, he may grant such permit in Form-A.] 5on payment of the fee (inclusive of consideration) of Rs. 1000
Prohibition against drawal, possession, etc.of toddy ताडी काढणे, बाळगणे इत्यादीस मनाई
The licensee shall not draw, possess, or transport toddy required for sale at his licensed shop except from the trees which he has been authorized to tap on payment of duty in that behalf.
परवानाधारक आपल्या परवानाप्राप्त दुकानात विक्रीसाठी आवश्यक असलेली ताडी, ज्या झाडांचे छेदन करण्यास त्याला या संबंधात शुल्क भरून प्राधिकृत करण्यात आले आहे त्या झाडांव्यतिरिक्त काढणार नाही, ताब्यात ठेवणार नाही किंवा वाहतूक करणार नाही.
Permit for tapping ताडीचे झाड छेडण्यासाठीचा परवाना
The licensee shall make an application to the Superintendent in Form TD-4 for permission to tap toddy-producing trees and draw toddy therefrom for 1retail sale at his licensed shop.
On receipt of an application, the Superintendent, after verifying that the duty has been paid by the licensee on toddy trees secured by him, grant to the licensee a permit in Form TD-5.
Account of toddy to be maintained ताडीचा हिशोब ठेवणे
The licensee shall maintain at his licensed shop a register in Form TD-6 wherein he shall write before the closure of the licensed shop correct daily accounts of all quantities of toddy received, sold, lost, destroyed and held in balance by him at the licensed shop, 2[The licensee who stores and bottles toddy at a transit center shall maintain at that centre a register in Form TD-6A wherein he shall write before the closure for the day, correct daily accounts of all quantities of toddy received, disurbuted, lost and destroyed by him at the centre.]
परवानाधारक आपल्या परवानाप्राप्त दुकानात नमुना टीडी-६ मध्ये नोंदवही ठेवेल ज्यात तो परवानाप्राप्त दुकान बंद होण्यापूर्वी परवानाप्राप्त दुकानात त्याने प्राप्त केलेल्या, विकलेल्या, गमावलेल्या, नष्ट केलेल्या आणि शिल्लक ठेवलेल्या ताडीच्या सर्व प्रमाणांचा योग्य दैनिक हिशोब लिहील. संक्रमण केंद्रावर ताडी साठवणारा आणि बाटलीबंद करणारा परवानाधारक त्या केंद्रावर नमुना टीडी-६ए मध्ये नोंदवही ठेवेल ज्यात तो दिवसाच्या शेवटापूर्वी केंद्रावर त्याने प्राप्त केलेल्या, वितरित केलेल्या, गमावलेल्या आणि नष्ट केलेल्या ताडीच्या सर्व प्रमाणांचा योग्य दैनिक हिशोब लिहील.
Unsold Toddy विक्री न झालेली ताडी
Unsold toddy at one licensed shop shall not be diverted or sold at any other licensed shop.
3[Provided that, unsold toddy may be sold to the holder of a licence in Form-I appended to the Maharashtra Distillation of Spirit and Manufacture of Potable Liquor Rules, 1966, for distillation of spirit and such toddy is transported under cover of a pass in Form TD-3B.]
एका परवानाप्राप्त दुकानातील विक्री न झालेली ताडी इतर कोणत्याही परवानाप्राप्त दुकानात वळवली किंवा विकली जाणार नाही. परंतु, विक्री न झालेली ताडी मद्यार्क आसवनासाठी महाराष्ट्र मद्यार्क आसवन व सेवनयोग्य मद्य उत्पादन नियम, १९६६ ला जोडलेल्या नमुना-I मधील परवान्याच्या धारकास विकता येईल आणि अशी ताडी नमुना टीडी-३बी मधील पासाच्या संरक्षणाखाली वाहतूक केली जाईल.
Quantity of toddy to be sold विक्री करावयाच्या ताडीचे प्रमाण
which is more than 124 hours old (time being calculated from the time, marked on the transport pass in Form TD-3) ;
unless it is pure and unadulterated ;
unless it is drawn and obtained according to the provisions of these Rules.
which is mixed with chloral hydrate or any other substance, or in which 1any foreign substance is put, added or mixed, thereby causing impurity or decrease or increase in is alcoholic strength ;
and toddy which a licensee cannot possess or sell or expose for sale as a aforesaid shall be destroyed.
Mode of transport of toddy ताडी वाहतुकीची पद्धत
4Except as otherwise provided in rule 14, toddy drawn for sale at one licensed shop shall not be transported along with the toddy drawn for sale at another shop in one and the same container. However, one conveyance may be used for transporting toddy to different shops.
नियम १४ मध्ये अन्यथा तरतूद केली असेल त्याव्यतिरिक्त, एका परवानाप्राप्त दुकानात विक्रीसाठी काढलेली ताडी एका आणि त्याच पात्रात दुसऱ्या दुकानात विक्रीसाठी काढलेल्या ताडीसोबत वाहतूक केली जाणार नाही. तथापि, वेगवेगळ्या दुकानांमध्ये ताडी वाहतूक करण्यासाठी एक वाहन वापरले जाऊ शकते.
Hours of sale विक्रीचे तास
1[Subject to the provisions of rule 6, the licensee shall not sell toddy except between 7 a.m. and 510 p.m. ] :
Provided that the licensed shop may be kept open beyond the aforesaid hours of sale for such time as is nesessary for its cleaning, receiving receptacles containing toddy, and completing accounts, but no sale of toddy shall be made during such period.
नियम ६ च्या तरतुदींच्या अधीन राहून, परवानाधारक सकाळी ७ ते रात्री १० वाजेपर्यंत वगळता ताडी विकणार नाही : परंतु, परवानाप्राप्त दुकान वर सांगितलेल्या विक्रीच्या वेळेनंतर ते स्वच्छ करण्यासाठी, ताडी असलेली पात्रे प्राप्त करण्यासाठी आणि हिशोब पूर्ण करण्यासाठी आवश्यक असलेल्या वेळेसाठी उघडे ठेवता येईल, परंतु अशा कालावधीत ताडीची विक्री केली जाणार नाही.
No unnecessary articles to be kept in licensed shop परवानाप्राप्त दुकानात अनावश्यक वस्तू ठेवू नयेत
The licensee shall not keep any other article in the licensed shop unless such article is necessary for the conduct of his business in connection with the sale of toddy therein.
परवानाधारक परवानाप्राप्त दुकानात इतर कोणताही वस्तू ठेवणार नाही जोपर्यंत अशी वस्तू त्याच्या तेथे ताडीच्या विक्रीच्या संबंधात त्याच्या व्यवसायाच्या संचालनासाठी आवश्यक नसेल.
Employees कर्मचारी
Subject to the provisions of sub-rule (2), a licensee may employ such employees as he thinks necessary, and shall execute a Nokarnama in favour of every employee so employed in connection with his business of sale to toddy in Form TD-7, and shall enter the names of all such employees in the Register in Form TD-8.
The licensee shall not employ any of the following persons as his servants to assist him in his business in any capacity whatsoever, namely :
(i) persons below 21 years of age;
(ii) persons suffering from any infectious or contagious disease;
(iii) 1persons who are insane;
(iv) persons who in the opinion of the Superintendent are notoriously bad characters;
(v) persons whose Nokarnamas or licences have previously been cancelled;
(vi) persons convicted of any criminal offence :
Provided that in the case of persons falling under clauses (v) and (vi), the disqualification may at any time be removed by a written order of the Collector.
Toddy not to be sold to certain persons विशिष्ट व्यक्तींना ताडी विकू नये
lunatics,
persons who are in an intoxicated state,
persons known or suspected to be participating in any rioting or disturbance of pace,
members of the Police and the Armed Forces of the Union, members of the Prohibition and Excise, State Transport and Railway Departments or drives of buses, when on duty or in uniform or both, and
persons who are under 21 years of age.
Toddy to be sold for distillation ताडी गाळण्यासाठी विकणे
The licensee may sell toddy to the holder of a licence in Form ‘I’ appended to the Maharashtra Distillation of Spirit and Manufacture of Potable Liquor Rules, 1966 for distillation of spirit and that the transport of such toddy shall be under cover of a pass in form TD-3B].
परवानाधारक मद्यार्क आसवनासाठी महाराष्ट्र मद्यार्क आसवन व सेवनयोग्य मद्य उत्पादन नियम, १९६६ ला जोडलेल्या नमुना 'I' मधील परवान्याच्या धारकास ताडी विकू शकतो आणि अशा ताडीची वाहतूक नमुना टीडी-३बी मधील पासाच्या संरक्षणाखाली असेल.
Stay at night in licensed shop of unauthorized persons prohibited अनधिकृत व्यक्तींच्या परवानाप्राप्त दुकानात रात्री मुक्काम करण्यास मनाई आहे
—The licensee shall not allow any person except authorised servants holding a valid Nokarnama to stay at night in the licensed shop.
परवानाधारक वैध नोकरनामा धारण करणाऱ्या प्राधिकृत नोकरांव्यतिरिक्त कोणत्याही व्यक्तीस परवानाप्राप्त दुकानात रात्री राहण्याची अनुज्ञा देणार नाही.
Toddy sales to be cash only. ताडी विक्री रोखीनेच करावी
All sales of toddy shall be made for cash only.
ताडीची सर्व विक्री केवळ रोखीने केली जाईल.
Licensed shop to be open for inspection of officers परवानाप्राप्त दुकान अधिका-यांच्या तपासणीसाठी उघडे ठेवणे
The licensed shop and the toddy therein shall at all times be open to inspection by the officers empowered under section 122 of the Act.
परवानाप्राप्त दुकान आणि त्यातील ताडी सर्व वेळी अधिनियमाच्या कलम १२२ अन्वये अधिकारप्राप्त अधिकाऱ्यांच्या तपासणीसाठी उघडे असेल.
Books to be maintained in licensed shop परवानाप्राप्त दुकानात नोंदवह्या ठेवणे
The licensee shall purchase at his cost the Accounts Register in Form TD-6 and Visit Book, and maintain them, correctly. 1The Visit Book and the Accounts Register shall be page-numbered and got sealed with the seal of the Superintendent, and properly kept in the licensed shop for inspection of officers to record their inspection remarks therein. The Visit Book and 1Accounts Register shall not be removed from the licensed shop at any time except under proper written authority and the licensee will be responsible for their safe custody.

The licensee shall abide by the conditions of his licence and the provisions of the Act and the rules, regulations and orders made thereunder.

Permit for tapping trees and transport of toddy to distillery ताडीचे झाड छेदण्याचे व आसवनीला ताडी वाहतूक करण्याचा परवाना
Notwithstanding anything contained in these rules or the conditions of the licence, any holder of licence in Form-I (being a licence for constructing and working a distillery for the manufacture of spirit under the Maharashtra Distillation of Spirit and Manufacture of Potable Liquor Rules, 1966), may apply in Form TD-4 for permission to tap toddy-producing trees and obtain a permit in Form TD-5 for tapping such trees and drawing toddy therefrom and transport it to his licensed distillery premises for distillation of spirit; and thereupon, except as provided in this rules, all other provisions of these rules including the conditions of licence in Form TD-1 thereto shall apply mutatis mutandis to such licensee.]

Suspension or cancellation of licence परवाना निलंबन किंवा रद्द करणे
The licence may be suspended or cancelled in accordance with the provisions of section 54 or 56 or the Act.

Licensee not entitled to any compensation परवानाधारक कोणत्याही नुकसान भरपाईसाठी पात्र नाही
if any of the trees in respect of which a tree tapping permit is granted to him is withdrawn in the public interest, or
if his shop is re-auctioned for failure to pay any Government dues.]
Saving बचत
Nothing in these Rules shall apply to Neera, or affect the operation of any special rules. for the tapping of trees, for any purposes 1other than for selling toddy by retail sale under these Rules.
या नियमांतील कोणतीही गोष्ट नीराला लागू होणार नाही किंवा या नियमांखाली किरकोळ विक्रीने ताडी विकण्याव्यतिरिक्त इतर कोणत्याही उद्देशाने झाडे छेदण्याच्या कोणत्याही विशेष नियमांच्या कार्यवाहीवर परिणाम करणार नाही.
